RESOLUTION NO. 03-24
A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD
ENDORSING THE RESOLUTION OF THE WRIT OF MANDAMUS AND AUTHORIZING
EXPENDITURE OF FUNDS FOR STORM WATER PRETREATMENT.
WHEREAS, the City is the named Defendant in State of Oregon ex
rel Stingray Development, Inc., an Oregon Corporation, and Poage
Engineering & Surveying, Inc., and Oregon Corporation v. City of
Springfield, Lane County Circuit Court Case No. 16-03-03969; and
WHEREAS, the above case was an action pursuant to ORS 227.178 in
which Relator petitioned for a writ of mandamus ordering the
City to issue an approval of the Jordan Crest subdivision with
conditions; and,
WHEREAS, based on the recommendation of the City Manager and the
City Attorney that this matter be resolved, the City has filed
an Amended Certificate authorizing approval of the subdivision
with conditions.
NOW THEREFORE BE IT RESOLVED, that the Common Council of the
City of Springfield does hereby endorse and support the
resolution of the law suit as described above. The effective
date of this Resolution is the date of adoption.
The Common Council of the City of Springfield further authorizes
the expenditure of public funds to satisfy storm water pre-
treatment requirements for the subdivision.
Adopted by the Common Council by the City of Springfield,
Oregon, this 19th day of May , 2003.
