RESOLUTION NO .1l.b18 A RESOLUTION INITIATING ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF SPRINGFIELD AND REQUESTING THAT THE LANE COUNTY LOCAL GOVERNMENT BOUNDARY COMMISSION APPROVE THE ANNEXATION. WHEREAS, the Common Council is authorized by ORS 199.490(2)(a)(B) to initiate annexation upon receiving consent in writing from a majority of the electors registered in the territory proposed to be annexed and written consent from owners of more than half the land in the territory proposed to be annexed; and, WHEREAS, the property owners of certain territory signed a consent to annex (Exhibit A); and, WHEREAS, no registered voters reside within the territory; and, WHEREAS, the annexation area can be served with sanitary sewer through a connection to the west in South 47th Street at the intersection of Hailey Court; and WHEREAS, the territory to be annexed is within the Eugene-Springfield Urban Growth Boundary, is partially contiguous to the City Limits to the west, and can be provided immediately with urban services such as fire, water, sanitary sewer, parks, schools, police; and, WHEREAS, stormwater can be provided through on-site detention facilities in accordance with the provisions of the Engineering Design Standards Manual, then through a 6" storm water gravity line to the public system in South 4ih Street; and WHEREAS, the applicant is posting a performance bond for the improvement of the rights-of-way to be annexed; and WHEREAS, the Common Council supports the applicant's request for annexation, as the Annexation Agreement and Performance Bond ensures that fully improved public streets and public storm drainage are available to serve the annexation area. NOW THEREFORE THE CITY OF SPRINGFIELD DOES RESOLVE AS FOLLOWS: Section 1: The Common Council of the City of Springfield does hereby recommend approval of the annexation of the subject territories to the City by the Lane County Local Government Boundary Commission, Lane County, Oregon, said territory being described as follows: Township 18 South, Range 2 West, Section 5, Map 12, Tax Lots 9002 and 9100, and Township 18 South, Range 2 West, Section 5, Map 11, Tax Lot 400, as more particularly described in Exhibit B of this Resolution. Section 2: The effective date of this Resolution is the date of its adoption by the Council and approval by the Mayor. ADOPTED by the Common Council of the City of Springfield this 21 sIt day of April 2003, by a vote of ~ for and ~ against.
