ORDINANCE NO. 6058
AN ORDINANCE AMENDING THE EAST MAIN REFINEMENT PLAN DIAGRAM AND PLAN
DESIGNATION FROM LOW DENSITY RESIDENTIAL TO MIXED USE FOR PROPERTY KNOWN AS
ASSESSOR MAP NUMBER 17-02-33-34, TAX LOT 100, SOUTH OF SOUTH 52ND PLACE AND MAIN
STREET, IN THE CITY OF SPRINGFIELD.
WHEREAS, the proposed amendment was submitted in conformance with the provisions of the East Main
Refinement Plan, Springfield Development Code Article 3, the Metropolitan Area Plan, and applicable state statutes
and statewide goals; and
WHEREAS, the Springfield Planning Commission conducted a public hearing on the proposed East Main
Refinement Plan Diagram amendment on May 20,2003, and the testimony, findings, and conclusions of that
meeting have been considered by the Common Council of the City of Springfield; and
WHEREAS, the Springfield Common Council held a public hearing on June 16,2003, on the proposed amendment;
and
WHEREAS, findings and testimony submitted by the applicant and those in support of this amendment satisfy the
criteria of approval for the Refmement Plan amendments found in Section 8.030 of the Springfield Development
Code as set forth in the findings in the staff report dated May 20, 2003; and
WHEREAS, lawful notice of the amendment was published and posted; and
WHEREAS, the Common Council met in Council Chambers, at 225 Fifth Street on Monday, the 16th day of June
2003 (First Reading) and on July 7th, 2003 (Second Reading) at the hour of7:00 p.m., to hear testimony regarding
the proposed amendment;
NOW, THEREFORE, THE CITY OF SPRINGFIELD DOES ORDAIN, AS FOLLOWS:
Section 1: The Common Council finds that the legal notice of the hearing was lawfully published and posted; a
public hearing was held; that the public interest will not be impaired by the amendment of the East Main Refinement
Plan Diagram, and that the amendment will be in the best interest of the public and increase the benefit of the
property involved.
Section 2: The findings and testimony submitted by the applicant satisfy the criteria of approval for Refinement Plan
Amendments found in Section 8.030 of the Springfield Development Code as set forth in the findings of the staff
report dated May 20, 2003.
Section 3: That portion of the East Main Refinement Plan Diagram as described in Exhibit A of this Ordinance is
declared changed from Low Density Residential to Mixed Use.
Section 4: The findings set forth in Section 2 are adopted by the Common Council in support of this refinement
plan amendment and are hereby made part of the ordinance by reference.
Section 5: The City Recorder is directed to file certified copies of this ordinance with the Lane County Clerk, Lane
County Assessor, and Lane County Surveyor.
ADOPTED by the Common Council of the City of Springfield this 7th day of July, 2003, with a vote of'.3 for and
