6053 (General)
AN ORDINANCE AMENDING SECTION 5.600 ET SEQ, "CIVIL ENFORCEMENT OF
CODE INFRACTIONS" SPECIFICALLY SECTION 5.604(1) (a) "APPLICATION
AND AMENDMENT" OF THE SPRINGFIELD MUNICIPAL CODE TO APPLY THE
CIVIL INFRACTION PROCEDURE DESCRIBED BY SECTIONS 5.600 THROUGH
SECTION 5.626 OF THE SPRINGFIELD MUNICIPAL CODE TO THE FOLLOWING
ADDITIONAL LAWS OF THE CITY: SECTION 4.060 "PUBLIC NUISANCE";
SECTION 4.426 "DEPOSIT ON PROPERTY"; SECTION 4.428 "DEPOSIT OF
REFUSE UPON PROPERTY OF ANOTHER OR UPON PUBLIC PROPERTY"; SECTION
4.450 "PUBLIC HEALTH AND SANITATION" OF THE SPRINGFIELD MUNICIPAL
CODE.
The Common Council of The City of Springfield Finds as Follows:
1. Unlawful Discharges or activities causing Unlawful
Discharges as set forth in Springfield Municipal Code
Section 4.060 "Public Nuisances" is to be abated or enjoined
and damages assessed therefore in accordance with the
provisions of the City Code or any other manner provided by
law.
2 .
Deposit Upon Public or Private Property of objectionable
waste as set forth in Springfield Municipal Code Sections
4.426 and 4.428 impairs and is dangerous to public health
and sanitation.
3. Springfield Municipal Code Section 4.450 prohibits the
commission of any act which threatens, impairs, or is
dangerous to public health and sanitation or which hampers
the City in the promotion and maintenance of public health
and sanitation.
NOW THEREFORE, BASED UPON THE FOREGOING FINDINGS THE COMMON
COUNCIL OF THE CITY OF SPRINGFIELD ORDAINS AS FOLLOWS:
1 .
Section 5.604(1) (a) "Application and Amendment" of Section
5.600 et seq "Civil Enforcement of Code Infraction" is
hereby amended to include "Public Nuisance" Section 4.060 of
the Springfield Municipal Code.
2 .
Section 5.604(1) (a) "Application and Amendment" of Section
5.600 et seq "Civil Enforcement of Code Infraction" is
hereby amended to include "Deposit on Property" Section
4.426 of the Springfield Municipal Code.

Section 5.604(1) (a) ~Application and Amendment" of Section

hereby amended to include ~Deposit of Refuse Upon Property
of Another or Upon Public Property" Section 4.428 of the
Springfield Municipal Code.
4. Section 5.604(1) (a) ~Application and Amendment" of Section
5.600 et seq ~Civil Enforcement of Code Infraction" is
hereby amended to include ~Public Health and Sanitation"
Section 4.450 of the Springfield Municipal Code.
Adopted by the Common Council of the City of Springfield this
2nd day of June I 2003 by a vote of 6 in favor 0 against.
Approved by the Mayor of the City of Springfield this 2nd day of
June I 2003.
