ORDINANCE NO. 6037 (General)
An Ordinance Repealing the Process for Claims Related to
Regulatory Takings Arising Under the 2000 Amendment to Article I,
section 18 of the Oregon Constitution (Ballot Measure 7)
Repealing Sections 2.900 Et. Seq. "Regulatory Takings" of Chapter
2 "Government and Administration" of the Springfield Municipal
Code and Declaring an Emergency
The City of Springfield ordains as follows:
section 1:
section 2.900, Section 2.910, section 2.920,
section 2.930, Section 2.940, section 2.950,
section 2.956, Section 2.960, section 2.966,
Section 2.976, Section 2.980, and Section 2.986
"Regulatory Takings" of Chapter 2 "Government and
Administration" of the Springfield Municipal Code
are hereby repealed.
Section 2:
It being determined by the Common Council that the
repeal of the Ordinance providing the process for
claims related to Ballot Measure 7 regulatory
takings is immediately necessary for the public
health, safety, and welfare; and, that an
emergency therefore exists and that therefore this
Ordinance shall take effect immediately upon its
passage by the Council and approval by the Mayor.
Adopted by the Common Council of the City of Springfield this
2pt day of January 2003 by a vote of 4 in favor and 0
against.
