Review Process: This application is reviewed under Type I procedures listed in SDC 5.1-125,
and the Drinking Water Protection Overlay regulations in SDC 3.3-200.
SDC 3.3-235(D) Standards for Hazardous Materials within Time of Travel Zones
"Ten to Twenty Year TOTZ Standards. The storage, handling, treatment, use, production or
keeping on premises of more than 20 gallons of hazardous materials that pose a risk to
groundwater in aggregate quantities is allowed only upon compliance with containment and
safety standards specified by the most recent Fire Code adopted by the City. (6238)"
Finding: This review is based upon the materials submitted on February 23, 2010.
Finding: The property lies within the 10-20 year Time of Travel Zone to the 16th and Q Street
wellhead.
Finding: Requirements found in Uniform Fire Code Appendix II-E Section 3.2.7 for inspection
and record keeping procedures for monthly in-house inspection and maintenance of
containment and emergency equipment for all amounts of hazardous materials that pose a risk
to groundwater shall be met unless exempted.
Finding: Unless exempted, all hazardous materials that pose a risk to groundwater shall be
stored in areas with approved secondary containment in place (Uniform Fire Code Articles 2
and 8003.1.3.3)
Condition of Approval #1: The secondary containment will be verified by the fire Marshal
prior to occupancy. .

Finding: The HMMP can be approved, pending compliance with these conditions.
Occupancy will not be issued until'these items are resolved.
Condition of approval #2: The following items must be resolved prior to occupancy of the
building:
. The HMMP notes that weekly inspections will take place but does not include an
inspection form. Please include an inspection form that identifies areas that need
to be inspected (the HMMP template I provided has a sample inspection form).
· The HMMP states that inspection forms will be retained for no more than seven
years. Please indicate a minimum retention time (usually three years).
. The HMMP should identify spill kit locations.
. Part C indicates that the only haz mat storage area will be the paint storage room
adjacent to the paint booth; however, Section Ill, Part A identifies the custodial
closet as the only storage area. Please clarify and correct.
DETERMINATION: Based on the evidence in the record. the Director determines the
proposal complies with SDC 3.3-200. subject to the Conditions of Approval.
Summary of conditions
