Comments based on the submittal dated April 30, 2010.
Summary of remaining items
1. Revise the Hillside Development Manual:
. Lots 1-9, 39, 50 and 55
. Modify 2 sentences on sheet labeled "Conditions and Requirements Applicable
to All Lots".
2. Construct the fence around the RWD site and entry way.
3. Extend the storm water pipes from the public easement to Lots 13 and 15.
4. Revise the CCRs to include the restrictions on fencing.
5. Prepare deed restrictions for Lots 2-12, relating to fences in the PUE. A portion of the
condition is confusing and needs to be resolved between Jim and Byron.
6. Revise the Development Plan to show Tract A is not encumbered by the Preservation
Easement.
Conditions from tentative subdivision SUB2006-00006
"Condition 40: The applicant shall be responsible for 50% of the cost to construct an 8 foot high chain
link securih) fence around the RWD site and entry way. The fence shall be non-site obscuring and be
constructed, coated or painted black to blend with existing vegetation."
The fence must be constructed prior to approval of the plat. Refer to Page 33, Section V of the
tentative decision dated May 2, 2006. It states:
"The Director further finds that all conditions contained or incorporated herein
and at Attachment A of this decision must be met prior to approval of the
subdivision Final Plat, public improvement plans (PIPs) or other permits under
the timeframes established in the body of this report."
The storm pipes that cross Lots 12 and 16 to service Lots 13 and 15, shall be extended from the
public easement to the Lots. They will be located on a slope and will cross multiple lots. Unless
all four Lots will be developed concurrently, the storm pipes shall be installed prior to plat
approval.

Condition 5: Revise as indicated below.
Missing information:
Lot 4: slope easement not labeled
Lots 6-12, 16: include the 25' public utility easement.
Lot 39: access is not shown. The impact area does not connect to the frontage
(Vitus Lane) or to an access easement.
Lot 50: missing slope easement, building envelope, trees, driveway location
Lot 55: the impact area is unclear. Include a border around that area.
Revise the page labeled "Conditions and Requirements Applicable to All Lots". Revise
a sentence in the last two paragraphs.
. Second to last paragraph states: "Trees planted within Preservation Areas will be
selected from the list of approved trees identified below." Change to: "Trees
planted within Preservation Areas will be selected from the list of approve trees
identified in Sections 9.4 and 9.5 of the CCRs."
. Last paragraph states: "Trees planted within Conservation Areas will be selected
from the list of approved trees identified below." Change to: "Trees planted
within Conservation Areas will be selected from the list of approve trees
identified in Sections 9.4 and 9.5 of the CCRs."
Conditions from Tree Felling DRC2006-00006
"Condition 4: The Vegetation and Revegetation Report and CCRs shall be revised to prohibit fencing
within Preservation Easements and limit the use of fencing within Conservation Easements. Fences
within or around tree conservation easements shall be placed to avoid root da11Ulge, be non-site obscuring
and be constructed, coated or painted black to blend with existing vegetation. Fences shall not extend
south of the tree conservation easement at north provertv line across utility easement. Fences along the
north properttj line shall be in accordance with the fencing standards of SDC Article 16. The applicable
portions of the tree preservation easements shall be included in deed restrictions and CCRs subject review
and approval btj the City of Springfield."
. The CCRs (dated April 21, 2010) don't contain the restrictions on fencing. SDC Article
16 refers to the residential base zone development standards. This reference is
redundant and should not be included in the CCRs.
. The underlined portion of the condition is confusing. Can a homeowner put a fence
across the tree conservation easement? Can a homeowner put a fence across the RWD
easement? This will be resolved between Jim and Byron. The applicable portions of the
tree preservation easements (as resolved by Jim and Byron) shall be included in deed
restrictions (Lots 2-12) and the CCRs.
