NOTICE OF DECISION SPRINGFIELD PLANNING COMMISSION Major Variance -Wetlands Setback- Type III Case No. ZON2010-0001O Applicant: Property Owner: Pete and Wendy Cobarrubia Same as Applicant 3S643 Camp Creek Road Springfield, OR 97478 Subject Property Location: Plan/Zone Designation: End of 59th Street, south of Main Street Metro Plan Designation: Medium Density Assessor's Map and Tax Lot: 17-02-34-33 TL 503 Residential Zoning: Medium Density Residential Nature of the Application: An application for a major variance to resolve a hardship created by protection of the wetland and by the placement of a city stormwater pipe and related easement within the small portion of the site which is outside of the wetland. DATE OF NOTICE: September 10, 2010 DATE OF DECISION: September 8, 2010 DECISION OF THE PLANNING COMMISSION The Springfield Planning Commission considered four "Recommended Actions" related to a major variance request to fill and mitigate a small area of wetland on the applicant's property. Recommended Action # 1: Staff recommended that a proposed variance to the maximum driveway width for duplexes and single-family homes be denied. Recommended Action #2: Staff recommended that a proposed variance to the lO-foot rear yard setback be approved. Recommended Action #3: Staff recommended that a proposed variance to the development ,setback for wetlands be approved. ' Recommended'Action #4: Staff recommended that a proposed encroachment into an easement over an existing storm sewer pipe be denied. The Springfield Planning Commission voted 5-0, with 1 absent and no abstentions to approve Recommended Actions # 1, #2, and #3. The Commission voted to by the same margin to take no action on Recommended Action #4, preferring to allow the Springfield Public Works Department work with the property ownerto set the easement width over the storm sewer pipe at the time the applicant submits an application for site plan review. These actions taken by the Springfield Planning Commission are final actions, APPEALS SDC Section S.l-13S (E) states that the Planning Commission's decision is the City's final decision, unless appealed. The decision is effective the day notice is mailed to the applicant, property owner and those persons who submitted written or oral testimony. The Planning Commission's decision may be appealed within is calendar days to the City Council as specified in Section S.3-120 (B). The appeal must be submitted on a City form and a fee of $2,322.00 must be paid with the submittal. The fee will be returned to the appellant only if the City Council approves the Appeal Application. Any action taken to begin development prior to the expiration ofthe appeal period is solely atthe applicant's risk and expense, The City assumes no liability or expense if the development is ultimately terminated based upon the outcome of the appeal.
