APPLICATION TYPE: Major Variance
NATURE OF THE APPLICATION: The applicant requests a variance to the established wetland
protection setbacks and to the side and rear yard setbacks to allow construction of a duplex and an single
family dwelling on his property at the end of S. 59th Street. '
AUTHORIZED USES: Uses in the Medium Density Residential zoning district are regulated by
Springfield Development Code (SDC) section 3.2-210, 3.2-215, and section 4.3-117 for Wetland Protection,
available in City Hall or online at: htto://www.ci.soringfield.or.us/dsd/Planning/.
APPLICABLE CRITERIA: (1) An unusual condition exists that is unique to: a lot, building or structure;
lot size, shape or topography; the location or size of physical improvements; or other similar circumstances
not anticipated by this Code related to the property that would deprive the owner of rights commonly enjoyed
by other property owners similarly situated in the same zoning district; (2) The Variance shall not be
inconsistent with the development standards of this Code or of any applicable Refinement Plan diagram, Plan
District map, Conceptual Development Plan or other applicable plans or studies; (3) The variance shall have
no significant adverse affects on other properties in the same zoning district and/or vicinity, or the request
can be conditioned so that there are no significant adverse affects; (4) The unusual condition described in
Subsection (1) ofthis Section shall not; arise from a previous Code violation or rely only on loss of profit or
financial need. (5) The Variance requested is the minimum necessary to alleviate the unusual condition.
SUBJECT PROPERTY LOCATION: Vacant lot at the end of S. 59th Street (east side ofthe street) near
the intersection with Aster Street, Map 17-02-34-33, T L 503
DATE, TIME, PLACE AND LOCATION OF THE HEARING: CORRECTED DATE---Wednesday,
September 8, 2010, at 7:00 p.m. at 225 Fifth Street in SpringfieldCity Hall Council Chambers.
ADDITIONAL INFORMATION: The application, all documents and 'evidence submitted by or on behalf
of the applicant and the application criteria are available for inspection at City Hall at no cost and will be
provided at a reasonable cost. Seven days prior to the hearing a copy of the staff report will be similarly
available.

Commission c/o DSD, 225 Fifth Street, Springfield, Oregon 97477, or attend the meeting and state your
views. The hearing will be conducted in accordance with SDC Article 14.
FAILURE TO RAISE ISSUE: Failure of an issue to be raised in at the hearing, in person or by letter, or
failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to
the issue precludes appeal to the Land Use Board of Appeals on that issue.
