NOTICE OF PUBLIC HEARING
Springfield Planning Commission
For Case #ZON2010-00010: Cobarrubia
A public hearing is scheduled for September 4,2010 at 7:00pm before the Springfield Planning
Commission to consider a requested variance to Springfield Development Code Sections 3.2-215
(property line setbacks) and 4.3-117 (wetland setbacks). The applicant seeks to build a duplex and single
family residence on the subject site. The property is zoned Medium Density Residential. It is a vacant lot
located at the end of S. S9th Street, near Aster Street in Springfield. The lot is identified on the Lane
Assessor's Map as 17-02-34-33, Tax Lot 503.
The hearing will be held in the City Council Chambers at the Springfield City Hall, 225 Fifth Street,
Springfield. In reaching a decision on this action, the Planning Commission shall adopt findings, which
demonstrate that all of the following criteria have been addressed:
A. An unusual condition exists that is unique to: a lot/parcel, building or structure; lot/parcel size,
shape or topography; the location or size of physical improvements; or other similar circumstances not
anticipated by this Code but related to the property that would deprive the owner of rights commonly
enjoyed by other property owners similarly situated in the same zoning district;

B. The variance shall not be inconsistent with the development standards of this Code or of any
applicable Refinement Plan diagram, Plan District map, Conceptual Development Plan or other applicable
plans or studies;
C. The variance shall have no significant adverse affects on other properties in the same zoning
district and/or vicinity, or the request can be conditioned so that there are no significant adverse affects;
D. The unusual condition described in Subsection A. above shall not arise from a previous Code
violation or rely only on loss of profit or financial need;
E. The variance requested is the minimum necessary to alleviate the unusual condition.
The variance application, all documents and evidence relied upon by the applicant, the applicable
criteria and a copy of the staff report are available for a free inspection and copies will be available at a
reasonable cost.
Failure of an issue to be raised in at the hearing, in person or by letter, or failure to provide statements
or evidence sufficient to afford the decision maker an opportunity to respond to the issue precludes
appeal to the Land Use Board of Appeals on that issue. For more information contact Mark Metzger,
