The Public Works Development Review section has reviewed the materials provided with the
subject application. The required findings and conditions outlined belo\v are provided for your
implementation into the land use decision.
General
Finding: Approval of this application would allow the existing East Side Baptist Church to
construct a new church building and expand their parking lot. The entite development site is
located on Tax Lot 4000 of Map 17-02-31-14.
Sanitarv Sewer System:
Finding: Section 4.3-105.A of the SDC requires that sanitary sewers shall be installed to serve
each new development and to connect deve.lopments to existing mains.IAdditionally, installation

of sanitary sewers shall provide sufficient access for maintenance activities.
Condition: The applicant shall give the City of Springfield an access jasement through their
parking lot to maintain the sewer systems that run along the edges ofth~ property. This
easement shall not confer any responsibilitY for maintenance of the parking lot to the city except
for damage caused during access to the public utilities.
Finding: The City's EDSPM states in Section 2.02.8 that sewers shall be located in the right-of-
way at street centerline or within 5 feet of centerline of the .street. Sew~rs in easements shall .
only be allowed after all reasonable attempts to place the mains in the rights-of-way have been

exhausted. The applicant property has existing service lines along the full length of the
southwest and northwest property boundaries without sufficient easemdnts for the city to obtain
access to these lines to perform maintenance.
Condition: The applicant shall provide public utility easement of 10' along the full length of the
southwest and northwest boundaries of the property.

Stormwater Quantity:
Finding: Section 4.3..11O.B of the SDC requires that the Approval Authority shall grant
development approval only where adequate public and/or private stormwater management
systems provisions have been made as determined by the Public Works Director, consistent with
the Engineering Design Standards and Procedures Manual (EDSPM).
Finding: Section 4.3..11 O.E of the SDC requires new developments to employ drainage
management practices, which nllnimize the amount and rate of surface water run-off into
receiving streams, and which promote water quality.
Stormwater Qualitv
Finding: Under Federal regulation ofthe Clean Water Act (CW A), Endangered Species Act
(ESA), and National Pollutant Discharge Elimination System (NPDES), the City of Springfield
has obtained a Municipal Separate Storm Sewer System (MS4) permit. A provision of this
permit requires the City demonstrate efforts to reduce the pollution in urban stormwater to the
Maximum Extent Practicable (MEP).
Finding: Federal and Oregon Department of Environmental Quality (ODEQ) rules require the
City's MS4 plan address six "Minimum Control Measures." Minimum Control Measure 5,
"Post-Construction Stormwater Management for New Development and Redevelopment,"
applies to the proposed development.
Finding: Minimum Control Measure 5 requires the City of Springfield to develop, implement
and enforce a program to ensure the reduction of pollutants in stormwater runoff to the MEP.
The City must also develop and implement strategies that include a combination of structural or
non-structural Best Management Practices (BMPs) appropriated for the community.
Finding: Minimum Control Measure 5 requires the City of Springfield use an ordinance or other
regulatory mechanism to address post construction runoff from new and re-development projects
to the extent allowable under State law. Regulatory mechanisms used by the City include the
Springfield Development Code (SDC), the City's Engineering Design Standards and Procedures
Manual (EDSPM) and the future Stormwater Facilities Master Plan (SFMP).
Finding: As required in Section 4.3-110.E of the SDC, "a development shall be required to
employ drainage management practices approved by the Public Works Director and consistent
with Metro Plan policies and the Engineering Design Standards and Procedures Manual."
Finding: Section 3.02 of the City's EDSPM states the Public Works Department will accept, as
interim design standards for stormwater quality, water quality facilities designed pursuant to the
policies and procedures of either the City of Portland (BES), or the Clean Water Services
(CWS).

Finding: Section 3.03.3.B of the City's EDSPM states all public and private development and
redevelopment projects shall employ a system of one or more post-dev~loped BMPs that in
combination are designed to achieve at least a 70 percent reduction in the total suspended solids
in the runoff generated by that development. Section 3.03.4.E of the ~anual requires a minimum
of 50 percent of the non-building rooftop impervious area on a site shall be treated for
stormwater quality improvement using vegetative methods.
Finding: The proposal will use a combination mechanical and vegetative means to meet the
,
above requirements. The mechanical means will consist of new dual chambered catch basins in
the existing parking lot. The new parking lots will use vegetative mearis consisting of bio-
swales. The vegetation proposed for use in the swales will serve as thelprimary pollutant .
removal mechanism for the stormwater runoff, and will remove suspenoed solids and pollutants
through the processes of sedimentation and filtration. Satisfactory pollhtant removal will occur
only when the vegetation has been fully established.
Condition: Prior to approval of the final site plan, the applicant shall provide an operations and
maintenance plan to the City for review to ensure the long-term maintehance and operation of
the proposed dual chambered catch basins and bio swales. There is a f6rm attached to this
decision for this for the applicant to review and then sign and return if Jaiisfactory to the public
works department.
Condition: To ensure a fully functioning water quality system and meet objectives of
,
. Springfield's MS4 permit, the Springfield Development Code and the EDSPM, the proposed
private vegetative water quality swale shall be shall be fully vegetated ~ith all vegetation species
established prior to approval of Final Plat, while the grassy swale/detedtion pond shall be fully
vegetated with all vegetation species established prior to City acceptan6e of the Public
Improvement Project. Alternatively, if this condition cannot be met, thk applicant shall provide
and maintain additional interim erosion control/water quality measures 'acceptable to the Public

Works Department that will suffice until such time as the swale vegetation becomes fully
established.
Public Works Stormwater System ImDacts
Finding; The applicant is providing for treatment of both the old and new proposed paving.
There are no significant offsite Storm water system impacts.

PUBLIC STREETS, SInEW ALKS & IMPROVEMENT AGREEMENTS
Finding: Section 4.2-1 05.G.2 of the Springfield Development Code requires that whenever a
proposed land division or development will increase traffic on the City street system and that
development has any unimproved street frontage abutting a fully improved street, that street
frontage shall be fully improved to City specifications. Exception (i) notes that in cases of
unimproved streets, an Improvement Agreement shall be required as a condition of Development
Approval postponing improvements until such time that a City street improvement project is
initiated.
Condition: Prior to approval of the Final Plat, the applicant shall execute and record an
Improvement Agreement for Commercial Street for curb, gutter, sidewalk and storm sewer if
necessary .
FEES AND PERMITS
SYSTEMS DEVELOPMENT CHARGE:
Pay applicable Systems Development Charges when building permits are issued for
developments within the City limits or within the Springfield Urban Growth Boundary. (The
cost relates to the amount of increase in impervious surface area, transportation trip rates, and
plumbing fixture units. Some exceptions apply to Springfield Urban Growth areas.) [Springfield
Code Chapter II, Article II]
Systems Development Charges (SDC's) will apply to the construction of buildings and site
improvements within the subject site. The Charges will be based upon the rates in effect at the
time of permit submittal for buildings or site improvements on each portion or phase of the
development
Please contact Clayton McEachern as soon as possible regarding this fee, for large developments
such as this the fee has the potential to be substantial.
OTHER CITY PERMITS:
Encroachment Permit or Sewer Hookup Permit (working within right-of-way or public
easements) example: new tap to the public storm or sanitary sewer, or adjusting a manhole.

Maintenance Agreement for Priyate Storm water Management and
Treatment System
In order to meet requirements of the City of Springfield MS4 Stormwater Discharge
Permit the City has implemented several policies requiring private proJerty owners to install and
maintain facilities that manage and treat stgrmwater runoff before disc~arge to the public
stormwater system.
