GRANT OF TEMPORARY WATER LINE EASEMENT
THIS AGREEMENT made and entered into on t=e.O~A~'-{ 't....S~ 't..oc.:>7, by and between
Alberts Develooment LLC . hereinafter called the first party, and City of Sorin!!field. a
municioal comoration actin!! bv and throUlzh the Sorin!!field Utility Board. hereinafter called the
second party, WITNESSETH:
. WHEREAS: The first party is the record owner of Lot 115 of MOUNT AINGA TE 2ND
ADDITION, as platted and recorded Marl,h ~o 0"7 Reception No.

and has the unrestricted right to grant the easement hereinafter described relative to the real
estate;
NOW, THEREFORE, in view of the premises and in consideration of $-0-. it is agreed:
The first party hereby grants; assigns and sets over to the second party, a temporary
easement for an above-ground water line, towit:
An easement across a portion of Lot 115 of MOUNTAINGATE 2ND ADDITION, as platted and
recorded (\.tar,.;" 2~ 2L:>OL, Reception No. J.,Do7- 2.0:s z..J , Lane County Official
Records, lying 15.00 feet Southerly of and perpendicular to the property line common to said Lot
115 of said subdivision and Lot 100 of MOUNTAIN GATE 1ST ADDITION, as platted and
recorded April 3, 2006, Reception No. 2006-022556, Lane County Official Records, more
particularly described as follows:
Beginning at the Westernmost comer of said Lot 115, said point also being on the Easterly right-
of-way line of Forest Ridge Drive; thence along the Northerly line of said Lot 115 North
55020'05" East 248.28 feet to a point on the Northerly line of said Lot 115, said point also being
the Initial Point of said MOUNTAIN GATE 1ST ADDITION; thence South 34039'55" East 15.00
feet; thence South 55020'05" West 248.19 feet to the Westerly line of said Lot 115, said point also
being on the Easterly right-of-way line of Forest Ridge Drive; thence following along said right-
of-way line North 34059'57" West 15.00 feet to the Point of Beginning, all being in Springfield,
Lane County, Oregon.

PURPOSE: The purpose of the temporary easement is to allow access to an above-
ground water line necessary to serve the subdivisions of MOUNT AINGA TE, as platted and
recorded May 10, 2005, Reception No. 2005-033764 Lane County Official Records;
MOUNTAINGATE 1 ST ADDITION, as platted and recorded April 3, 2006, Reception No. 2006-
022556, Lane County Official Records; and MOUNTAINGATE 2ND ADDITION, as platted and
recorded f-.\a.rGlrl 1.~. ~, Reception No. 'UX77 - 20'-'52-1 , Lane County Official
Records.
JERMINA TION ~ It is the intent of the parties that the easement provided herein is
temporary. This easement shall cease, desist, and expire at such time as the water system in said
MOUNTAINGATE 2ND ADDITION becomes operational. If necessary to provide record notice
of such expiration, City shall sign appropriate documents for recordation.
IN WITNESS WHEREOF, the parties have hereunto set their hands on the day
and year first written above.
