Application Fee - refer to the Development Code Fee Schedule for the appropriate fee
calculation formula. A copy of the fee schedule is available at the Development Services
Department. Any applicable application, technology, and postage fees; are collected at
the pre-submittal and submittal stages.
Land Division Plat Application Form
Letter Addressing Conditions of Approval - lists and addresses each condition of
approval, detailing the actions taken and current status of each item.
Nine (9) Paper Copies of the Plat stamped and signed by the surveyor.
Two (2) Copies of Closure Sheets for the boundary and each lot or parcel and all
common areas, dedicated areas, and easement 'areas that are not simple parallel offsets.
Two (2) Copies of Title Report or Subdivision Guarantee for the parcel being
divided. The title report must be dated within 30 days of submittal at the time of the final
submittal. An older report is OK at the pre-submittal stage.
Two (2) Copies of Each of the Reference Documents and Plats listed on the plat.
Two (2) Copies of Each of the Supporting Documents - the vesting deed (must vest
title to the owner listed on the plat), existing easement deeds, and documents listed as
exceptions in the title report, etc.
Two (2) Draft Copies of any street dedications.
Two (2) Draft Copies of Any New Easements or Restrictions being created by
separate document, improvement agreements, maintenance agreements, joint use
ingress/egress and utility easements, sewer hook up in lieu of assessment, and any other
documents that will be recorded together with the plat or that are required by the
Conditions of Approval.
Two (2) Copies of a Consent Statement (Concurrence) on the plat (to be signed by
the lender prior to final approval) OR Two (2) Copies of an Affidavit of Consent by
separate document is required from all Trust Deed, mortgage, or other secured loan
interest holders against the property to be recorded simultaneously with the plat IF any
public dedications or easements are being made and/or any other interests are being
transferred to the public per ORS 92.075 (2-4).
Copies of Wetland Documents as required.
Copies of ODOT Access Permits as required.
Draft Copy of Bargain and Sale Deed for Reserve Strips - City Survey Section has a
template.
Verification that Street Tree Agreement is in Progress as required.
Draft Copy of the Conditions, Covenants & Restrictions (ccM&SOOMITTAl REC'D

NOTE: When, as part of the approval process, the application has been conditioned so that the
recordation of a document is required, the applicant shall be responsible for paying the Lane
County recording fee for any such required document. Documents which may require
recordation include, but are not limited to: Development Agreements; Improvement
Agreements; Deed Restrictions; Future Development Plans; Easements; Joint Use Access/
Maintenance Agreements; and Dedications of Right-of-Way.

Dear Damien Gilbert:
I am pleased to inform you that the Oregon Department of Transportation has approved
your Application for State Highway Approach. Before you proceed with any work i1 the
highway right of way, you need to obtain a Permit to Construct from the DepartlTlent
This letter provides instructions on what you need to do to obtain your Per nit to
Construct.
Since your approach conforms to the standard designs available in ODOTs Hig,way
Design Manual .and Standard Drawings, the Department is providing approved
construction drawings for your use. Attached are Preliminary Constrl1ction
Specifications that include construction drawings and all terms and conditions that the
Department will include in your Permit to Construct.
If you agree to the attached Preliminary Construction Specifications, please retum the
following items. to us by 5:00 p.m. on 11/30/2010:
o A copy of the Preliminary Construction Specifications with your sigrature
confirming your agreement
o Proof of liability insurance (see attached Oregon Administrative Rule OAR
734-051-0215).
o A performance bond in the amount of $2,000 or a cash deposit in leu of
bond in the amount of $2,000, payable to ODOT
Our approval of your application will become void if all items are not returned withn 60
days from the date of this letter. Please contact me if you need to extend this deadine.

Subject:
Liability and Control for Construction and Maintenance, Repair,
Operation and Use of Approaches (OAR 734-051-0215)
Oregon Administrative Rule 734-051-0215 states:
(1) An applicant or permittee assumes responsibility for damage or injury to any person or
property resulting from the construction, maintenance, repair, operation, or use of an apprrnch
for which a Construction Permit or a Permit to Operate is issued and where the applicant nny be
legally liable.
(2) An applicant or permittee indemnifies and holds harmless the State of Oregon, the
Commission, the Department, and all officers, employees, or agents of the Department aganst
damages, claims, demands, actions, causes of action, costs, and expenses of whatsoever na1Ure
which may be sustained by reasons of the acts, conduct, or operation of the applicant, his agents,
or employees in connection with the construction, maintenance, repair, operation, or use of an
approach.
(3) Construction of an approach may not begin until the applicant provides the Department
with evidence of insurance in the following minimum amounts:
(a) $50,000 for property damage resulting from any single occurrence, or $500,000
combined single limit; and
(b) $200,000 for the death or injury of any person, subject to a limit of $500,000 for any
single.occurrence.
(4) msurance policies must include as named as insured the State of Oregon, the
Commission, and the Department, its officers, agents and employees, except as to claims against
the applicant, for personal injury to any members of the Commission or the Department and its
officers, agents, and employees or damage to any of its or their property.
(5) Construction of an approach may not begin until a copy of the insurance policy or t
certificate showing evidence of insurance is filed with the Department.
(6) An applicant or permittee shall provide 30 days written notice to the Department 0"
intent to cancel or intent not to renew insurance coverage. Failure to comply with notice
provisions does not affect coverage provided to the State of Oregon, the Commission, or tlr
Department, its officers, agents and employees. .
(7) If the highway surface or highway facilities are damaged by the applicant or the
applicant's contractor, the applicant must replace or restore the highway or highway facilites to
a condition satisfactory to the Department.
(8) The applicant or permittee must furnish, in an amount specified by the Region Mar.ager
and for the time period necessary to install the approach, a cash deposit or a bond issued by a
surety company licensed to do business in the State of Oregon to ensure that any damage to the
highway has been corrected to the Department's satisfaction; and no construction is performed
until a deposit or bond is filed with the Department.
(9) The applicant or permittee is responsible for relocating or adjusting any utilities located
on highway right of way when required for accommodation of the approach, and no construction
may be performed until the applicant furnishes evidence to the Department that satisfactof)
arrangements have been made with the owner of the affected utility facility.
.(10) The applicant or permittee is responsible for erosion control during construction cfthe
