RE: Relocation of Easements on Tax Lot 17-3-36-3 I :0740 I

Dear Chris:
I have spent some time going over the easements to be relocated and I think I finally have this de-
ciphered.
Although the ownership and location of the deeds in this area are overlapping and confusing, due
to cet1ain of the deeds not being available at this time, I believe we have a reasonable
understanding of the chains of title and grants of easements in this area. There are only four
easements that appear to be potentially valid and are potentially over all or a part of the current
Tax Lot 740 I according to our deed research and the Title Report.
The potentially valid easements are those that appear to have been signed by actual owners of the
lands in question at the time the casements were granted and they are:
I. The easement from John and Margaret Gilbet1son, Bk 352, Pg 313, a blanket over
a parcel roughly 90' east/west X 484' north/south beginning 3,833.98' East of the
NW corner of DLC #83 and on the north DLC line. This is called as easement 2.2
on the relocation document.
2. The easement from Tom May, I3k 353, I'g 509, a blanket over a parcel roughly
167' east/west X 484' north/south (with about 119' of frontage on Main St.)
beginning 3,805.41' east of the NW corner of DLC #83 on the DLC line. This is
called as easement 2.3 in the relocation document.
3. The easement from Thorvald and Lorntine Johansen, Bk 394, Pg 367, a blanket
over a parcel roughly 90' east/west X 484' nOI'th/south beginning 3,83398' East of
the NW corner of DLC #83 (this is the samc description as I. above). This is
called as easement 2.2 in the relocation document.
4. The easement fl'om Gretchen Wilson, Document 70405, recorded Mav, 1955.

This easement is a strip easement and was actually signed by Gretchen Wilson in
1945. This easement is called as easement 2.4 in the relocation document.
The easement from Johansen in Document 70405 was never signed by either Johansen and
therefore the easement description in this document does not represent a valid easement.
We have edited the Easement Relocation Agreement to include the Wilson easement but have
deleted the description of the Johansen easement in Document 70405. Note, however, that the
grant from Johansen recorded in Book 394, Pg 367 is included in the relocation however. .
