HomeMy WebLinkAboutOrdinance 6262 11/15/2010ORDINANCE NO. 6 2 6 2 (Gener~.l) , AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD AMENDING CHAPTER 7 "BUSINESS, AMBULANCE AND EMERGENCY MEDICAL SERVICES", SECTION 7.036 "EXEMPT PERSONS AND ACTIVITIES" TO ADD A NEW EXEMPTION FOR VEHICLES OPERATED BY ANOTHER MUNICIPALITY PURSUANT TO AN INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF SPRINGFIELD. WHEREAS, Section. 7.032 of the Springfield Municipal Code provides that no person shall establish, maintain, or operate an ambulance or other emergency medical services business within the City unless a license for that use, is obtained from the City; and WHEREAS, Section 7.036 of the Springfield Municipal Code provides for certain persons and activities which are exempt from the requirements for license as well as other requirements of Sections 7.030-7.078 "Ambulance and Emergency Medical Services"; and WHEREAS, the Department of Fire and Life Safety has recommended that "vehicles operated by another municipality pursuant to an intergovernmental agreement with the City of Springfield or vehicles operated by a subcontractor of another municipality which municipality has entered into an intergovernmental agreement with the City of Springfield. for the provision of ambulance services" be added to the list of exempt. persons and activities set forth in Section 7:036; and WHEREAS, ORS 190.010 provides that units of local government may enter into agreements for the performance of any and all functions and activities that -any party to the agreement, its officers, or agents have authority to perform; and WHEREAS, the. Common Council of the City. of. Springfield has thoroughly reviewed and considered the recommendation; and z NOW, THEREFORE, THE CITY OF SPRINGFIELD ORDAINS AS FOLLOWS: Section 1. Anew subsection, 7.036, "Exempt Persons and Activities (7)" is hereby added to Springfield Municipal Code Section .7.036 as follows: "7.036 Exempt Persons and Activities. The provisions of Section 7..030 to 7.078 do not apply to: (7) Vehicles operated by another municipality .pursuant to an intergovernmental agreement with the City of Springfield or vehicles operated by a subcontractor of another municipality which municipality has entered into an intergovernmental agreement with the City of Springfield for the provision of such ambulance service."
