Dear Ms Bryant,
The City of Springfield is in receipt of two Performance Bonds for the subject project: one in
the amount of $393,734.00 for the remainder of the construction of the public improvements,
and another in the amount of $60,000.00 for the landscaping. These Performance Bonds have
been approved by the City's contract officer and legal counsel.
Pursuant to the terms of the July 10, 2007 letter to John Revell of Liberty Bank (copy enclosed),
the City of Springfield hereby authorizes Liberty Bank to release the funds in the set aside letter
for the Westwind Estates Subdivision. Please note, however, that such release of funds will not
be, and will not be construed as, any verification of quality of construction of improvements,
quantity of construction of improvements, or adherence to City of Springfield specifications with
respect to the improvements.
Also, please be advised that the City will not approve the Final Plat for Westwind Estates
Subdivision until the public improvements and the landscaping are complete, a final inspection
is conducted and approved by City inspectors, the as-builts for the public improvements have
been received and approved by the City, and the project has been accepted by the City
Council. The Performance Bonds will be held by the City for the warranty periods of one (1)
year for the public improvements and two (2) years for the landscaping after the date of City
Council approval.
