Staff agree with your contention that the building was developed as part of a larger development phase that met the requirements of SDC 3.2-515(1). This staff interpretation has been reached based on the imminent completion of the NWSC building on the proposed parcel and the contiguous Peace Health hospital, and is not intended to be precedent-selling. Any future proposals for development areas (vacant or built-out) that do not meet the one-acre minimum will be reviewed independently based on the merits of the site and the supporting arguments. One item of interest that did arise during earlier discussions was the Building Code provisions for the sky bridge and the potential implications of creating new property lines that intersect the open connections between adjacent buildings. Staff wanted to give you a heads-up that this issue may be reviewed in more detail with the City's Building Official, the Fire Marshal, and the project architect.
