TYPE I TENTATIVE MINIMUM DEVELOPMENT STANDARDS, STAFF REPORT & DECISION Project Name: Blue Bird Auto Sales Nature of Application: Expansion of vehicle sales onto the southern portion of the site. Change of use on the southern portion of the lot from trailer sales to trailer and vehicle sales. Case Number: DRC2010-00012 Project Location: 122 36'" Street; Map and Taxlot 17-02-31-42 TL 4100 Current Site Conditions: The site is on the Northwest corner of 36'" Street and Main Street. It is developed with a 3200 square foot building and paved parking area. Four driveway approaches exist on the site. There is one driveway access from Main Street, which they are proposing to close and three approaches onto 36'" Street. The site is divided by a 6' fence which currently delineates the auto repair shop and limited vehicle sales from the trailer sales. Background: This site has been through two previous Minimum Development Standards reviews. In 1998 they applied for and received approval to pave the southern portion of the lot to display small trailers for sale by the business next door (Wheeless Trailers Sales and Service). In 2000 they applied for and received approval to add limited car sales to their auto repair business on the north portion of the lot. Purpose: Minimum Development Standards (MDS) are intended to support economic development by minimizing City review for minor additions, expansions or changes in use. MDS shall ensure compliance with specific appearance; transportation safety and efficiency; and stormwater management standards specified in the Springfield Development Code (SDC) and otherwise protect public health, safety and welfare. 5.13-120 SDC Standards Applicable to MDS Approval Criteria of Approval: In order to grant MDS approval, the Director shall determine compliance with all applicable standards specified below. Final occupancy is contingent upon the completion of required site improvements. Special Use Standards: Finding: SDC Section 4.7-ll5(C) states that all activities associated with motor vehicle repair and service, with the exception of maintenance activities including the pumping gas or changing tires, shall take place within a building constructed to ensure that noise or odors do not disturb the normal operation or tranquility of neighboring residential, commercial, campus industrial or public land uses. Storage of motor vehicles to be repaired shall be screened by a sight-obscuring fence. o Complies as Shown on Plot Plan ~ Proposal Complies when the following Condition(s) is/are met: Condition 1: Repair or replace broken and/or missing slats in the chain link fence so that it provides uniform site obscuring screening on all sides. A) A five-foot wide landscaped planter strip, including street trees, with approved irrigation or approved drought resistant plants as specified in SDC Sections 4.4-100 and 4.2-140 shall be installed between the sidewalk and parking areas or buildings. EXCEPTIONS: 1. Where there is an unimproved street, a four foot wide landscaped planter strip shall be required to be set back one foot from the property line. 2. Where there is insufficient space for the landscaped strip required in Subsection A., above due to existing buildings, street width, paved parking, changes of elevation or location of utilities including catch basins, the Director may approve: a. Decorative fencing located immediately behind the property line. The fencing may be wrought iron or masonry and shall be subject to MDS - DRC2010-00012 2 . . the fence height standards of the applicable zoning district and the vision clearance setbacks of Section 4.2-130; and/or b. Landscaping equivalent to the amount required in Subsection A., above may be placed at the property corners or other areas of the property that are visible from the street. D Complies as Shown on Plot Plan ~ Proposal Complies when the following Condition(s) is/are met: Condition 2: Currently there are no street trees shown on the submitted plan. Street trees are required to be placed approximately every 30 feet. The Final Plot Plan must show street trees along the Main Street frontage. Show the existing L TD bus stop on the Final Plot Plan at the correct scale. Street trees shall be from the species listed in the Engineering Design Standards Manual 6.02.2.A List of Acceptable Street Trees from the section entitled "Any Planter Strip with Overhead Power Lines" (See attached). Trees shall be located 35 feet from the perpendicular curb line of street intersections; 5 feet from an alley intersection, driveway, water meter or other utility fixture and 10 feet from any uti lit ole. B) Trash receptacles and outdoor storage areas shall he screened by a structure or enclosure permanently affixed to the ground as specified in SDC Section 4.4-100. ~ Complies as Shown on Plot Plan D Proposal Complies when the following Condition(s) is/are met: C) Bicycle parking spaces shall be added to meet the numerical standards for the appropriate use or upgraded to meet the standards set in SDC Sections 4.6-140,4.6145 and 4.6-155. D Complies as Shown on Plot Plan ~ Proposal Complies when the following Condition(s) is/are met: Condition 3: One three-space bicycle parking rack shall be shown on the Final Plot Plan and installed per SDC 4.6-140 prior to occupancy. MDS - DRC201O-00012 3 . . D) Parking and circulation areas shall be paved and striped and wheel stops installed as specified in SDC Sections 4.6-100 and 4.6-120. Required paving and otber impervious surfaces on the site shall comply with on-site stormwater management standards as specified in SDC Section 4.3-110 for required parking, circulation area and storage area impervious surfaces only. EXCEPTION: In cases where the number of vehicular parking spaces cannot be met due to lot size or physical constraint, the Director, in consultation with the Transportation Planning Engineer, may reduce the standard without a Minor Variance if a finding is made that the reduction will not have an adverse impact on public safety. D Complies as Shown on Plot Plan ~ Proposal Complies when the following Condition(s) is/are met: Finding: The code requires II parking spaces for the Auto Repair and Vehicle Sales activities at this site. The submitted plan shows seven spaces with an additional five spaces designated for vehicle sales. The applicant has proposed keeping five of the existing vehicle sales spaces on the northern portion of the site. In order to provide the minimum required parking spaces for employees and customers and to provide for the safe and efficient inb'fess/egress of vehicles, no vehicles which are for sale shall be parked in the parking lot on the northern portion of the site. All vehicles for sale shall be parked in the area designated for vehicle and trailer sales on the southern portion of the site. Finding: Driveways shall be designed as specified in Tables 4.2-2 through 4.2-5 and the City's Engineering and Design Standards and Procedures Manual and the Public Works Standard Construction Specifications. A minimum driveway throat depth of 18 feet is required to provide a clear access aisle. Condition 4: Provide a Final Plot Plan showing all vehicle sales on the southern portion ofthe lot and showing two additional customer/employee parking spaces where the five used cars for sale had previously been. The two additional parking spaces shall be placed to facilitate safe and effective traffic flow and reduce conflict with other parking spaces when backing out. The garage bays may be counted as credit for two of the required spaces. Finding: SDC 4.6-120 states that all parking spaces shall be permanently and clearly marked and that old striping shall not be visible after being replaced by new striping. Condition 5: Prior to occupancy, the two new parking spaces shall be marked and all old striping of parking spaces on the site shall be removed if replaced by new striping. MDS - DRC201O-00012 4 . . ',.., , " ' Vehicles for sale are to be moved to southern portion of the site. This area is to be designated as employee/ customer parking. Limited to two head-in, angled spaces. All vehicles for sale to be stored on this portion of the site. Finding: SDC 4.6-120 states that adequate drainage improvements shall be provided to dispose of all on-site run-off. Condition 6: To comply with SDC section 4.3-110, the existing double chambered catch basin on the site shall be maintained in ood workin order. E) Access onto the public right-oC-way shall comply with SDC Section 4.2-120. o Complies as Shown on Plot Plan [8J Proposal Complies when the following Condition(s) is/are met: Finding: The applicant is proposing to close the access onto Main Street and has applied to aDaT for permit and permission to remove unpermitted approach and replace with sidewalk and curb. Condition 7: Provide the City with a copy of an approved aDaT permit to remove the approach and make the required improvements according to aDaT specifications. Easements may be required as specified in Subsection 4.3-]40 of this Code. ~ Complies as Shown on Plot Plan o Proposal Complies when the following Condition(s) is/are met: Timelines and Conditions of Approval: The property owner and/or applicant has 30 days from the date of this decision to submit a Final Plot Plan (the Final Plot Plan must be to scale and indicate the scale on the plan) demonstrating compliance with the following Conditions of Approval: Condition]: Repair or replace broken and/or missing slats in the chain link fence so that it provides uniform site obscuring screening on all sides. Condition 2: Currently there are no street trees shown on the submitted plan. Street trees are required to be placed approximately every 30 feet. Condition 6: To comply with SDC section 4.3-110, the existing double chambered catch basin on the site shall be maintained in good working order. Condition 7: Provide the City with a copy of an approved ODOT permit to remove the approach and make the required improvements according to ODOT specifications. Check with the City of Springfield Engineering Department for any necessary city permits. In order to complete the review process, a Development Agreement is required within 4S days from the date of this decision to ensure the terms and conditions of this application are binding upon both the applicant and the City. This agreement will be prepared by Staff and upon approval of the Final Plot Plan, must be signed by the property owner prior to issuance of a building permit and land use approval. The construction of the required improvements shall begin within 90 days of the date of this decision. If the established time line cannot be met, the applicant may submit a written request for a time line extension as specified in SDC Section 5.15-125. The Director may allow a one-time extension of the 90-day start of construction time line due to situations including but not limited to, required permits from the City or other agencies, weather conditions and the unavailability of asphalt or the unavailability of street trees. If the time extension is allowed, security shall be provided as specified in SDC Section 5.17-150 of this Article. The time line extension shall not Exceed 90 days. If the established time line is not met and the applicant has not requested an extension, the Director shall declare the application null and void if the property is occupied and the property owner shall be considered in violation of this Code. If the established time line is not met and the applicant has requested an extension and that time line has not been MDS - DRC2010-00012 7 . . met, the Director may require the improvements be installed as specified in SDC Section 5.7-150. Permits That May Be Required: . Sidewalks and driveway curb cuts and closures require permits from the Public Works Department. . Sign Permit-NOTE: Signs are regulated by the Springfield Municipal Code Article 9, Chapter7. The number and placement of signs must be coordinated with the Community Services Division. The location of signs on a Site Plan does not constitute approval from the Community Services Division. Additional Information: The application, all documents, and evidence relied upon by the applicant, and the applicable criteria of approval are available for free inspection and copies are available for a fee at the Development Services Department, 225 Fifth Street, Springfield, Oregon. Appeals: This Type 1 decision is exempt from the provisions ofORS 197.195, 197.763 and 227.173 and therefore cannot be subject to the appeal provisions of SDC Section 5.3- 100, Appeals.
