SITE INFORMATION
The property is located at 2645 South Cloverleaf Loop (Assessor's Map# 17-03-22-43;
Tax Lots 1000 and 1100. The property is zoned Medium Density Residential (MDR); the
Gateway Refinement Plan designation is Medium Density Residential. The property is
surrounded by other properties zoned and designated Medium Density Residential. The
property is flat.
RESPONSE TO VRITTEN COHKENTS
There were no wri t ten comments on this request.
CRITERIA OF APPROVAL (Ref. Section 31.060 of the SDC).
(1) COMPLIANCE VITH THE SUBMITTAL REQUIREMENTS OF SECTIONS 3.050 AND 31.050 OF THIS
CODE.
The application was accepted as complete by the City on January 27, 1994.
However, compliance wi th the submi t tal requirements does not necessarily mean
that all Springfield Development Code (SDC) standards have been met.

The property is served by all utilities required by this proposal. Sani tary
sewer is available from South Cloverleaf Loop (Contact Don Branch 726-3753 for
addi tional information). The building drainage can utilize a weephole to the
street. However, the parking lot will require a catch basin connected to the
Ci ty storm drain system (Contact Lorne Pleger 726-3669 for additional
information). Yater and electricity are provided by SUB (746-8451); contact Ken
Cerotsky for water charges and Virgil Langley for electric charges.
Note: A major sanitary sewer trunk line is proposed to cross the rear of the
property. A 20 foot-wide permanent sanitary sewer easement beginning along the
south property line and an additional temporary construction easement will be
required (Contact Don Branch 726-3753 foraddi tional information and the proper
easemen t. form).
City of Springfield Systems Development Charges will be determined at the
building permit application process. There is also a Yillamalane Park and
Recreation District Systems Development Charge, which will be collected by the
City.
Cloverleaf Loop is fully improved, except for street trees and sidewalks. The
Plan submitted shows street trees and sidewalks.
In order to construct over a common property line, the 5 foot-wide side yard
setback required by SDC Section 16.050(2) needs to be waived by recording a deed
restriction at Lane County Courthouse.
(3) INVENTORIED NATURAL (INCLUDING REGULATED VETLANDS) AND HISTORIC FEATURES OF THE
SITE HAVE BEEN ADEQUATELY CONSIDERED IN THE PROJECT DESIGN.
The Metro Plan; the Gateway Refinement Plan; the draft Natural Resource Special
Study, the National Yetlands Inventory Map, the draft Springfield Yetland
Inventory Yetland Map and the Hydric Soils Map; the Yashburne Historic District
and, the lis t of Historic Landmark Si tes, have been consulted. There are no
inventoried natural or historic features on the development site.

PARKING AREAS AND INGRESS-EGRESS POINTS HAVE BEEN DESIGNED SO AS' TO FACILITATE
TRAFFIC AND PEDESTRIAN SAFETY, TO AVOID CONGESTION AND TO MINIMIZE CURB CUTS ON
ARTERIAL OR COLLECTOR STREETS AS SPECIFIED IN ARTICLES 31, 32, THE APPROPRIATE
ZONING AND/OR ZONING OVERLAY DISTRICT ARTICLE AND ANY APPLICABLE REFINEMENT PLAN.
Sidewalks will be constructed as shown on the Plan submitted to accommodate
pedestrian safety.
Section 16.070(7) of the SDC requires .25 parking spaces for each bedroom and one
space for each employee per shift. The applicant depicts four parking spaces for
10 bedrooms and one employee per shift. This meets the requirements of the SDC.

Tax 1100 abuts a dedicated walkway to the west. The walkway appears to be utilized
as part of 'the plan submitted (lawn and a gate). The Ci ty considers this walkway to
be public right-of-way. In order to be utilized for private use, it must be vacated.
The vacation process takes approximately 8 weeks; the application fee is currently
$850.00 plus a $50.00 pos tage fee for notice. The Ci ty would support the vacation
application since the walkway ends at The Point condominium property which is
currently fenced and would feed into a travel lane for the parking area. However,
this applicant should know that only one-half of the walkway would revert to Tax Lot
1100; the other five feet would revert to the lot to the west.
1lIIAT NEEDS TO BE DONE BY THE APPLICANT TO OBTAIN FINAL SITE PLAN APPROVAL? '
1. Three copies of a Final Site Plan, drawn to scale, is required within 90 days of
the date of this letter showing the following information:
a. The sanitary sewer trunk line easement and construction easement.
b. Either a note that the walkway is proposed to be vacated or the elimination
of the gate.
c. .The location of the required catch basin in the parking area.
2. Since this proposal involves construction over property lines, a deed restriction
will be required to be recorded at Lane County at the applicant'S expense prior
to occupancy which will waive the 5 foot sideyard setbacks required by SDC
Section 16.050(2).'
3. A signed Development Agreement. This agreement will be prepared by'staff to be
signed.
APPEAL
If you wish to appeal this Type II Limited Land Use Site Plan Review decision, you
must do so wi thin 10 days of the date of this letter. Your appeal must be in
accordance wi th Springfield Development Code, Article 15, APPEALS. Note: Appeals
. mus t be submi tted on a Ci ty form and a fee of $100.00 must be paid to the City at the
time of submittal. The fee will be returned to the appellant if the Planning
Commission approves the appeal application.

Listed below are our comments for the above reference development proposal:
1. The proposed development is within Springfield city limits and will receive water
service from the Springfield Utility Board.
2. Size of water line and other water facilities, including water meters, shall be
approved by SUB and meet the long-range needs of the City. All water meters
will be placed in public right-of-way at a location identified by the developer.
3. Please ask the developer to contact SUB for information about fees, materials,
and standards.
4. Water service will be installed upon collection of development charges. For a 3/4"
standard water service and meter, the development charge is $700'per service.
Larger meters would cost more. A backflow prevention device may be required
on one or more services.

SITE PLAN REVIEV DEVELOPMENT AGREEMENT
THIS DEVELOPMENT AGREEMENT, hereinafter "Agreement", is entered into on the;2,;2.~

3.080(3), 3.090(3), and 3.100(3).
RECITALS
VHEREAS, on the 18th day of March, 1994, the City approved the Site Plan
submitted by the Applicant:
CITY JOURNAL NUMBER 94-01-12. Type II Site Plan requesting approval to construct a
residential facility for elderly and handicapped individuals. Residential facilities
for 15 or fewer people each are a permitted use under SDC Section 16.020(9)(d) which
requires si te Plan Review. The property is located at 2645 South Cloverleaf Loop
(Assessor's Map# 17-03-22-43; Tax Lots 1000 and 1100. The property is zoned Medium
Density Residential (MDR); the Gateway Refinement Plan designation is Medium Density
Residential.
WHEREAS, in consideration for Si te Plan approval, the issuance of a Building
Permi t, and the issuance of an Occupancy Permi t, as specified in the Springfield
Development Code Section 31.090, Applicant agrees to comply with all the standards of
the Springfield Development Code and Springfield Municipal Code which may be
applicable to this development project unless modified or excepted by the Site Plan
Review Development Agreement, Planning Director, Planning Commission, Building
Official or their agents, or the Fire Marshal, which modifications or exceptions
shall be reduced to.writing.
WHEREAS, in consideration for Site Plan approval, the issuance of a Building
Permi t, and the issuance of an Occupancy Permit, as specified in the Springfield
Development Code Section 31.090, Applicant agrees to comply with the following
specific conditions imposed by the City as part of the Site Plan approval:
1. All improvements must be constructed/installed as shown on the Final Si te Plan
dated March 9, 1994.

THEREFORE IN CONSIDERATION OF THE FOREGOING RECITALS WHICH ARE EXPRESSLY MADE A PART
OF THIS AGREEMENT, CITY AND APPLICANT AGREE AS FOLLOWS:
AGREEMENT
1. FINAL SITE PLAN. The applicant has submitted a Final Site Plan in
accordance with Section 31.080 of the Springfield Development Code.
2. STANDARDS. The applicant agrees to fulfill all applicable standards
specified in the Springfield Development Code and the specific standards listed in
RECITALS prior to occupancy, unless certain standards have been deferred to a later
date in accordance with Section 31.110 of the Springfield Development Code.
3. CONDITIONS. The Applicant agrees to fulfill all specific conditions of
approval required by the City listed in RECITALS prior to occupancy, unless certain
conditions have been deferred to a later date in accordance with Section 3l.040(4)(b)
of the Springfield Development Code.
4. MODIFICATIONS. The applicant agrees not to modify the approved Final Site
Plan without first notifying the City. Modifications to the Final Site Plan shall be
reviewed in accordance with Section 31.100 of the Springfield Development Code. .
5. MAINTAINING THE USE. The applicant agrees to the following:
(a) The building and si te shall be maintained in accordance with the
provisions of the Springfield Development Code in order to continue the use.
(b) It shall be the continuing obligation of the property owner to
maintain the planting required by Section 31.140 of the Springfield Development Code
in an attractive manner free of weeds and other invading vegetation. In addition,
plantings in the vision clearance area shall be trimmed to meet the 2 1/2 foot height
standard in accordance with Section 32.070 of the Springfield Development Code.
(c) Parking lots shall be maintained by the property owner or tenant in a
condi tion free of litter or dust, and deteriorated pavement condi tions shall be
improved to maintain conformance with these standards.
(d) Undeveloped land within the development area shall be maintained free
of trash and stored materials in a mowed and attractive manner. Undeveloped land
shall not be used for parking.
6. In addi tion to all other remedies which may be provided by law or equi ty
(including but not limited to penalties provided by applicable State Law or City
Ordinances), Applicant agrees that City may enforce Applicant's responsibilities by
withholding Applicant's Final Occupancy Permit, and terminating any Temporary
Occupancy Permit which may have been granted.
7. Any Final Site Plan approved becomes null and void if construction does not
commence within two years of the date of this Agreement.
