Subject: Bob Straub Parkway Intersection Location-Hayden Homes
After our meeting on September 30, 2010, I had a chance to review the Agreement prepared by City staff and between
Gordon Webb, the City of Springfield, and Lane County dated July 13, 2007, wherein the location of the permanent
intersection was addressed. The Agreement specified that the permanent intersection will be permitted to be constructed
in the vicinity of the Webb temporary driveways located at approximate Engineer's Station 109+50 (R & L). Any use of the
Webb driveways by other than Webb prior to construction of the permanent intersection improvements, and the eventual
construction of the intersection will be subject to review by Lane County and the approval of a Lane County Facility Permit
prior to any work in the County right of way.
In reviewing the proposed construction plans for Hayden Meadows Phases 9 and 10, particular attention will be given to
adherence to that portion of the Master Plan addressing maintaining the drainage patterns existing on the land prior to the
development of the subdivision phases, and that the development will not result in any increase in the storm water
volumes to be diverted onto County right of way. We would also like to know the schedule for. the City Hayden addressing
the existing storm water ponding problem along the westerly right of way line of the Parkway adjacent to Phases 7 and 8
of Hayden Meadows, as this will continue to be an ongoing problem during heavy rainfall periods. We have discussed this
with City staff on several previous occasions, and the County's position is that is a result of the Storm water Master Plan
not being constructed in accordance with the approved plans. It should be corrected in conjunction with the construction
of the improvements for Phases 9 and 10.
One additional outstanding item is that we have not received the remaining agreed upon Dedication of Public Right of
Way from the Milland property. If you'll recall, the right of way on the westerly side of the centerline from approximate
Engineer's Stations 95+00 to 129+50 was dedicated by Milland in 2007 as agreed. The 2004 Agreement called for the
parcels which contained the remainder of the needed right of way, including the full width of the right of way from Station
129+50 to the south line of the Milland Property, and from the north line of the Milland property to Station 129+50 on the
east side only to be purchased from Milland by the City, the intent being that the needed right of way would be in turn
dedicated to the County by the City.
We know it is the position of the city that this has been delayed pending formulation of the development plan for the
Milland Property and in connection with the final wetlands determination as well as Milland's apparent indecision to either
retain Parcels A,B,C and D or to sell them to the City as per the agreement entered into between the County, the City and
the various project grantors back in 2004. All other right of way for this project was dedicated more than three years ago

in fulfillment of the 2004 Dedication A!ements, and as we have pointed out prevtlY, the right of way needed from the
Milland property will not be impacted by the wetlands determination, the eventual development plan for the property or the
:1 sale or non-sale of the parent parcels to the City, so there is no need to delay this further.
This remaining dedication is needed in order to complete the formal acceptance of SSP as a County Road. Please
pursue the fulfillment of the Agreement in a timely manner on or before November 30, 2010.
