HomeMy WebLinkAboutResolution 10-61 10/18/2010.: ^1 RESOLUTION NQ. 10- 6.1 g A RESOLUTION DECLARING TWO FIRE PUMPERS OWNED BY THE CITY OF SPRINGFIELD AS SURPLUS AND DIRECTING THE CITY MANAGER TO SELL A 2004 PIERCE CONTENDER FIRE PUMPER TO LANE RURAL FIRE/RESCUE DISTRICT FOR THE SUM OF $85,000 ANI) TO DISPOSE OF THE 1999 PIERCE CONTENDER IN ACCORDANCE WITH CITY OF SPRINGFIELD MUNICIPAL CODE 2.714. WHEREAS, the City of Springfield provides public safety services to the citizens. of Springfield and our partner agencies; and, WHEREAS, the .City has determined that optimizing fire and ambulance response resources to achieve the best possible outcomes is a high priority; and, WHEREAS, the 1999 Pierce Saber fire pumper VIN 4P 1 CT02U9XA00140b and the ~ 4 2004 Pierce Contender fire pumper VIN 4P 1 CT02A34A004092 have outlived their useful lives as a viable part of the City's fire equipment, and are no longer needed by Springfield Fire & Life Safety; and, . WHEREAS, Lane Rural Fire/Rescue, an Oregon Special District, has a critical need for a fire pumper and is a long-time mutual aid partner of the City of Springfield, and, WHEREAS, the opportunity for public comment at a public hearing has been provided prior to the adoption of this Resolution, WHEREAS, pursuant to ORS 279A~.190, the City is authorized to transfer fire protection equipment between fire departments, upon written request for the equipment, if the equipment is surplus to the transferor. WHEREAS, Springfield Municipal Code Section 2.714 provides that the City may dispose of surplus property by any means determined to be in the best interest of the City with due regard for the value the City will receive from the disposal of the surplus property; NOW, THEREFORE, BE IT RESOLVED, that the. City Council hereby finds and determines that the Property is not needed for public use, and . BE IT FURTHER RESOLVED, that the City Manager is directed to accept $85,000 from Lane Rural Fire/Rescue District as full payment for 2004 Pierce Contender Pumper, in "AS IS" condition, with no warranties of any type, including but not limited to warranty of merchantability or fitness for a particular purpose, AND BE IT FURTHER RESOLVED, that the City Manager is directed to dispose of the 1999 Pierce Saber fire pumper in accordance with the City of Springfield Municipal Code Section 2.714, - ATTACHMENT 1 Page - 1 - of 2 ~ : ~Y: A1o1D BE IT FURTHER RESOLVED, that this resolution shall take effect upon adoption by the Council and. approval by the Mayor.
