'-/ City (jf Springfield, OR Memo To: Dave Puent From: Don Moore cc: Lisa Hopper Date: 4/29/2003 Re: Permit application for Scott Siegmund, for property at 1134 Delrose City Job #02-00290-01 The subject permit application was submitted on March 18,2002, Plan reviews by all departments were completed and permits were ready to issue by the first week of April 2002. Before the permits were issued, Public Works requested we place a "hold" on the permit due to problems with unauthorized backfill on the property. The property owner had apparently placed additional fill in the existing flood plain, and covered an existing drainage swale and an outfall structure for the drainage of the subdivision. I talked to the contractor at the customer service counter sometime in May 2002 and explained the issue as it was told to me by Ken Vogeney and Bob Kettwig. The contractor seemed satisfied once he knew that mitigation of the fill, drainage swale and outfall needed to be accomplished by obtaining a Land Drainage Alteration Permit (LDAP) before building permits could be issued, I understand that the owner and his attorney rnet last fall with Mayor Leiken, Gino Gramaldi, Cynthia Pappas, Ken Vogeney and Bob Kettwig to iron out the issues. I arn told that the owner was informed what he needed to do with the fill and drainage mitigation in order to obtain the building permit According to Bob Kettwig, the owner was to submit a remediation proposal to the City; to my knowledge, the proposal was never submitted. The permit has been on hold since last April. I heard nothing more about it until Poage Engineering called me early last week and asked for an interpretation of the . Page 1 \ . ~ t' I:) . intent of certain aspects of the Subdivision Geotechnical report as it relates to building foundations for the subject property, My recent discussion with Bob Kettwig verified that no progress has been made on the mitigation issue, The permit application has now expired and cannot be renewed. The State building Code requires that the owner submit a new application for review by the City in accordance with the latest Building Code changes.
