WHEREAS, the City of Springfield has enacted Resolution Number 10-33, dated June 7, 2010, marked as Exhibit "0", attached hereto and made a part of this Order, formally requesting that the jurisdiction of thes.e county road~, or portions thereof, which lie within the city limits, be transferred to the City of Springfield; and . WHEREAS, an Intergovernmental Agreement executed in 2003 between Lane County a.nd the City of Springfield for the Pioneer Parkway Extension project (Martin Luther King, Jr. Parkway) stipulated that upon completion of the project county roads within the project would be transferred to city jurisdiction; and . WHEREAS, in addition to the portions of Pioneer Parkway East and Pioneer Parkway West that were part of the Pionaer Parkway Extension project (Martin Luther King, Jr. Parkway) addressed in the 2003 Intergovernmental Agreement, and to facilitate additional jurisdictional transfers within previously annexed territory,' portions of Hayden Bridge Way, Harlow Road, Wayside Lane and Game Farm Road are also included in this surrender process; and WHEREAS, ORS 373.270 provides for the surrender and transfer of jurisdiction over county roads within a city in :that the county may transfer jurisdiction over county roads, or po.rtions thereof, . within a city when it is considered to be necessary, expedient, or in the best interest of the county to do so; and the governing body of the city deems it necessary or expedient and in the best interest of the city . to acquire jurisdiction over the county roads, or portions thereof, to the same extent as it has over public streets and alleys of the city; and . RD. 3) TO THE CITY OF ) SPRINGFIELD ) ,FINAL DIRECTOR'S REPORT The City of Springfield has passed Resolution Number 10-33, dated June 7, 2010, formally requesting the transfer of jurisdiction of these county roads, or portions thereof, located within the city limits. The City is ' requesting this surrender without a Partnership Program Agreement. An Intergovemmental Agreement executed in 2003 between Lane County and the City of Springfield for the Pioneer Parkway Extension project (Martin Luther King, Jr. Parkway) stipulated that upon completion of the project county roads within the project would be transferred to city jurisdiction. In addition to the portions of Pioneer Parkway East and Pioneer Parkway weSt that were part of that project, and to facilitate additional jurisdictional transfers within previously annexed territory, portions of Hayden Bridge Way, Harlow Road, Wayside Lane and GameFarm Road are also included in this surrender process. The various roads, consisting of a total of 0.70 miles of right of way, are listed in Exhibit "A" attached to and made a part of the Final Order for surrender of said roads. The subject roads are currently under the' 'jurisdi,ction of Lane County, and the transfer of jurisdiction over these county roads would enable the City to maintain, develop, and improve the roads to the City's own specifications, standards, and timetables. ORS 373:270 provides for the transfer of jurisdiction over county roads within a city. The county may transferjurisdiction over county roads, or portions thereof, within a city when it is considered to be necessary, expedient, or in the best interest of the county to do so; and the goveming body of the city deems it necessary or expedient and in the best interest of the city to acquire jurisdiction over the county 'roads, or portions thereof, to the same extent as it has over public streets and alleys of the city. All legal notice for the public hearing to consider the matter ofthe surrender of these portions of county , roads has been provided by the County Surveyor, as required by law. , , The surrender of these roads, or portions thereof, can serve the needs of the transportation system under the jurisdiction of either the City or County. In this case, the City of Springfield has requested that jurisdiction be transferred, and it is recommended that the Final Order to surrender the roads, or portions thereof, as described in Exhibit "A" of the Final Order, be approved, as it will be in the best interest of the County.
