Dear Mr. Metzger:
This letter is in response to the Conditions of Approval listed in the Staff Report and Notice of
Decision - Site Plan Review - Type llletter dated May 28, 2009. I have structured this letter
stating your comments first, followed by my response in bold italics. My response is as follows:
Condition of Approval 1/1
Execute and record five feet of street right-of-way dedication along the Q Street site frontage.
The existing paving width, the right of way width, half widths and dedication shall be
dimensioned on the final site plan.
Thefive foot right-of-way dedication has been shown on the site plan for future use.
See revised Sheet Al 00. It coincides with the existing five foot easement on the
property.
Condition of Approval 1/2
To ensure continued functioning of the curb inlet the pressure line from the detention basin will
need to first discharge into a manhole or other approved structure before gravity flowing into the
public system at the curb inlet.
We have not added another manhole to the project as we do not believe this is
necessary. The 10 inch pipe connected to the back of the curb inlet will not be
pressurized. It is correct that a small sump pump will direct water to this pipe,
. approximately 70 feetfrom the inlet However, the amount of water being pumped into
the 10 inch pipe will not cause the pipe to flow full, thus allowing it to act as a gravity
line. Also, the 70 feet of pipe has several connections for roof drains, etc. which will
allow any small amount of pressure at the upstream of the pipe to completely dissipate
prior to entering the curb inlet. The 10 inch pipe will act as a gravity pipe at the inlet
connection.

Therefore, wefeel it is not necessary to add another costly structure to the design as
this system will not adversely affect the operation of the existing curb inlet.
Condition of Approval #3
Prior to approval of the fmal site plan, the application shall provide an operations and
maintenance plan to the City of review to ensure the long-term maintenance and operation of the
proposed FLOGARD catch basin insert, consistent with maintenance criteria required by the
manufacturer. The plan should designate maintenance responsibility for operating and
maintaining the system, and should be distributed to all property owner and tenants of the site.
The manufacturers recommended maintenance plan has been attached to this
submittal, and should be incorporated into the development agreement to bind the
property.
Condition of Approval #4
Prior to Final Plat approval, the applicant shall submit a proposed seed mix for the private
vegetative water quality swales (bio-swales). The seed mix shall meet the requirements of the
City's interim design standards as required in Section 3.02 of the EDSPM. The City of Portland
storm water management manual may be referenced for design.
Please see revised Sheet LIOl for the seed mix information.
Condition of Approval #5
The proposed grassy swale at the northwest site corner appears to be graded to have only 3-4" of
depth. To provide adequate fimction and avoid overtopping this swale should be 6-12" deep (per
the "Grassy Swale" design in the Portland Storm Water Manual.) Provide as amended grade plan
providing this depth for the bio-swale.
The grading of the swale has been revised to meet a minimum depth of 6 inches along
the entire swale. This is shown on revised Sheets C2 and C5.
Condition of Aooroval #6
To ensure a fully fimctiouing water quality system and meet objectives of Springfield's MS4
permit, the Springfield Development Code and the EDSPM, the proposed private vegetative
water quality swale shall be fully vegetated with all vegetation species established prior to
approval of Final Plat. Alternatively, if this condition cannot be met, the applicant shall provide
and maintain additional interim erosion controJJwater quality measure acceptable to the Public
Works Department that will suffice until such time as the swale vegetation becomes fully
established.
The vegetation shall be installed as soon as the construction schedule allows and
properly nurtured and maintained to promote quick establishment for Approval of the
Final Plat. If the Final Plat Approval is needed before full establishment occurs,
addition erosion control measures shall be taken per the Public Works Department's
direction.

Condition of ADDroval #7
The Water Protection Coordinator for the Springfield Utility Board submitted a letter to staff on
May 6, 2009 outlining a series of actions and prohibitions that are required to protect groundwater
resource during the construction of the proposed dialysis clinic and its operation. The May 6
letter was copied to the applicant and the applicant's architect. These requirements are shown
below and are incorporated into this decision as Condition of Approval #7.
Acknowledged. The applicant, the applicant's architect, and the tenant are compiling
the necessary documents neededfor this permit and shall submit the required
information andfee directly to SUB. Measures to contain any fluid spills from the
diesel generator installed on the exterior of the building are shown in the attached
revised drawings.
Condition of ADDroval #8
The proposed access ways serving the site shall be built to support an 80,000 lb. imposed load per
2007 Springfield Fire Code 503.2.3 and SFX Appendix Dl02.1.
The access ways and parking lot have been designed with 3" of asphalt concrete over
10 inches of compacted crushed rock (see Sheets C3 & C6). This design is adequate to
support an 80,000 pound imposed load to meet Springfield Fire Code.
Condition of ADDroval #9
A Fire Department Connection (FDC) shall be required on the above ground vault for
supplementing the proposed fire sprinkler system. Immediate access to fire department
connections shall be maintained at all times without obstruction.by fences, bushes, trees, walls or
any other object for a minimum of3 feet (2007 Springfield Fire Code 912.3)

Condition of ADDroval #10
The site plan shows and emergency generator. Design specifications for the generator need to be
provided. More specifically, including the type of fuel used, size of the tank and whether it is a
Levell Emergency Power Supply System per NFP A 110 needs to be clarified.
Please see the enclosed Kohler Power Systems Diesel Generator 180REOZJD
manufacturer's cut-sheets and the revised Sheet Al 10 - Site Details, as well as
Specification Section 16231 for more information regarding the generator. The
generator is not intended for use as an 'emergency' generator per NFPA 110. The
generator is a stand-by back-up generator for use in long term power outages in order
to keep the dialysis service available. An 'emergency' generator per NFPA 110 is not
required as patients do not require life-supporting equipment; no general anesthesia is
used on site; and lightingfor egress purposes shall operate on a battery backup system.
Condition of ADDroval #11
The Final Site Plan shall specifY that all exterior lighting fixtures including those which are wall-
mounted shall have full cut-offs optics and supporting manufacturers specification shall be
submitted to confirm the design of those fixtures.

Please see the revised Sheet E050 with notes indicating that all exterior lightftxtures
shall havefull cut-off optics and shall be Dark Sky or Nighttime Friendly as indicated
by the manufacturers. Please also see the enclosed Exterior Light Fixture Cut-sheet
Packetfor manufacturer's specijications/literature.
Condition of Approval #12
Free standing lighting fixtures shall be limited to a height of 12 feet wherever such lighting poles
are located within 50 feet of an adjacent residentially zoned property. The Final Site Plan shall be
adjusted to note exterior lighting poles of appropriate height.
Please see the revised Sheet EIOO - Site Lighting Plan and Sheet A 100 - Site Plan for
the revised lighting pole locations. All poles shall have a height of 20 feet and no poles
shall be within a 50 foot distance from a residentially zoned property. All pole type
lightflXtures have afull-cut offphotometric and have been designed on the site to
prevent light spill onto adjacent properties. See revised Sheet E50.

GENERAL SPECIFICATIONS FOR MAINTENANCE OF
FLO-GARD@CATCH BASIN INSERT FILTERS
SCOPE:
Federal, State and Local Clean Water act regulations and those of insurance carriers require that storm water
filtration systems be maintained and serviced on a recurring basis. The intent of the regulations is to ensure
that the systems, on a continuing basis, efficiently remove pollutants from storm water runoff thereby
preventing pollution of the nation's water resources. These Specilications apply to the F1o-Gard@ catch
basin insert filters.
RECOMMENDED FREQUENCY OF SERVICE:
Drainage Protection Systems (DPS) recommends that installed Flo-Gard@ Catch Basin Insert Filters be
serviced on a recurring basis. Ultimately, the frequency depends on the amount of runoff, pollutant loading
and interference from debris (leaves, vegetation, cans, paper, etc.); however, as a minimum, it is
recommended that each installation be serviced a minimum of three times per year, with a change of filter
medium once per year. DPS technicians are available to do an on-site evaluation, upon request.
RECOMMENDED TIMING OF SERVICE:
DPS guidelines for the timing of service are as following:
I. For areas with a detinite rainy season: Prior to, during and following the rainy season.
2. For areas subject to year-round rainfall: On a recurring basis (at least three times per year)..
3. For areas with winter snow and summer rain: Prior to and just after the snow season and during
the summer rain season.
4. For installed devices not subject to the elements (washracks, parking garages, etc.): On a recurring
basis (no less than three times per year).
SERVICE PROCEDURES:
I. The catch basin shall be visually inspected for defects and possible illegal dumping. If illegal
dumping has occurred, the proper authorities and property owner representative shall be notilied
as soon as practicable.
2. The catch basin grate will be removed and set to one side. Then either:
a. An industrial vacuum shall be used to carefully remove all sediment and debris from
the Ii Iter portion of the unit, or
b. By grasping the tilter's stainless steel frame, the entire tilter shall be carefully removed
Irom the catch basin. The lilter medium pouches shall then be removed by unsnapping
the tether from the O-ring and set to one side. Being careful not to spill, the contents
shall be removed.
3. The tilter liner, gaskets, stainless steel frame and other components shall be inspected for
continued serviceability. Minor damage or defects found shall be corrected on-the-spot and a
notation made on the Maintenance Record. More extensive deliciencies that affect the efficiency
of the Ii Iter (torn liner, etc.), if approved by the customer representative, will be corrected and an
invoice submitted to the representative along with the Maintenance Record.
4. The filter medium pouches shall be inspected for defects and continued serviceability and replaced
as necessary. See below.
5. If removed, the filter device shall be replaced in the catch basin and the grate replaced.

REPLACEMENT AND DISPOSAL OF EXPOSED FILTER MEDIUM AND COLLECTED
DEBRIS
The frequency of filter medium pouch exchange will be in accordance with the existing DPS-Customer
Maintenance Contract. DPS recommends that the medium be changed at least once per year. During the
appropriate service, or if so determined by the service technician during a non-scheduled service, the tilter
medium pouches will be replaced with new pouches. Once the exposed pouches and debris have been
removed, DPS has possession and must dispose of it in accordance with local, state and federal agency
requirements.
DPS also has the capability of servicing all manner of catch basin inserts and catch basins without
inserts, underground oiUwater separators, stormwater interceptors and other such devices. All DPS
personnel are highly qualified technicians and are confined space trained and certified. Call us at

Specifications
HOUSING
The fixture and arm shall be cast aluminum. The
shade shall hinge open by loosening a captive screw
for relamping. The lens shall be molded tempered
borosilicate glass. The lens shall be sealed top and
bottom with silicone gaskets. The ballast assembly
shall be mounted on a plate that attaches to the
backside of the arm. Quick disconnects shall be
used for all electrical connections. All internal and
external hardware shall be stainless steel.
ELECTRICAL
All electrical components shall be U.L. recognized.
Magnetic HID ballasts shall be high power factor,
rated for -30' C starting. Sockets for T-6 lamps
shall be a G12 base. Medium base porcelain sockets
shall be pulse rated. Fluorescent lamps shall be
powered by an electronic ballast and shall be rated
for a minimum starting temperature of _18' C. The
electrical assembly shall be installed and prewired in
the fixture.
MOUNTING
The fixture/arm assembly shall be secured to the
arm with four stainless steel sect screws. Wall plate
attaches to the wall with two stainless steel 3/8"
bolts. Hardware by others. For pendant mounting.
the fixture shall be threaded to the stem.
FINISH
Fixture finish shall consist of a five stage pretreatment
regimen with a polymer primer sealer, oven dry
off and top coated with a thermoset super TGIC
polyester powder coat finish. The finish shall meet
the AAMA 605.2 performance specification which
includes passing a 3000 hour salt spray test for
corrosion resistance.
RELAMPING
Access to the lamp is accomplished by loosening four
captive set screws and safety cable at the underside
of the shade. The lamp compartment is accessed
by turning a knob that is attached to the removable
socket plate.
EISA COMPLIANCE
AAL is committed to complying with EISA require-
ments 100%. All applicable products manufactured
for sale in the United States after January 1, 2009, will
meet EISA requirements.

CERTIFICATION
The fixture is listed with ETL for outdoor, wet location
use, UL 1598 and Canadian CSA Std. C22.2 NO.250.

WARRANTY
Fixture is warranted for three years. Ballast
components carry the ballast manufacturer's limited
warranty. Made in the USA.

Housing - Rugged, die-cast, single-piece hous-
ing. Die-cast door frame has 1/8" thick tempered
glass lens. Door frame is fully gasketed with one-
piece solid silicone. Standard finish is textured
dark bronze {DDSD corrosion-resistant polyester
powder with other architectural colors available.
Optics - Interchangeable, segmented reflectors
for superior uniformity and control. Three full
cutoff distributions available: FT (forward throw),
MD (medium throw) and WT (wide throw). Four
uplight distributions available in W5R only: FTU
(forward throw, 10% up), MDU (medium throw,
10% up), WTU (wide throw, 10% up) and MDUS
(up/down, medium throw, 50% up, 50% down).
Compact fluorescent MD (medium throw) only,
Electrical - HID: SOW MH- 1 SOW utilizes a high
reactance, high-power factor ballast. 355 and
50S utilizes a reactor normal-power factor bal-
last. 175W utilizes a constant-wattage auto
transformer ballast. Quick-disconnect plug eas-
ily disconnects reflector from ballast. Ballasts
are copper wound and 100% factory tested.
CFL: compact fluorescent ballast is Class P, elec-
tronic, high-power factor, <10% THD with start-
ing temp.ofO' F (- 18'C).
Socket - HID is porcelain, medium-base copper
alloy, nickel-plated screw shell and center con-
tact (UL Listed 660W, 600V 4KV pulse rated). Flu-
orescent socket is high-temperature thermo-
plastic with integral lamp retention clip.
Installation - Universal mounting mechanism
with integral mounting support allows fixture to
hinge down. Bubble level provides correct align-
ment with each installation.

PACKAGED ENGINE GENERATOR
PART 1 - GENERAL
1.1 SCOPE OF WORK
A. The engine generator set will be purchased by the owner. Contractor is required to
install and place into operation according to manufacturer's recommendations.
1.2 RELATED DOCUMENTS
A. Drawings and general provisions of the Contract, including General and Supplementary
Conditions and Division I Specification Sections, apply to this Section.
1.3 SUMMARY
A. This Section describes the packaged engine-generator sets for standby power supply
with the following features:
1. Diesel engine.
2. Unit-mounted cooling system.
3. Unit-mounted control and monitoring.
4. Performance requirements for sensitive loads.
5. Load banks.
6. Outdoor sound enclosure.
7. Base-mounted fuel oil tank.
B. Related Sections include the following:
I. Section 01200 - "Project Meetings"
2. Section 03300 - "Cast-in-Place Concrete"
3. Sections 16170 - "Disconnect Switches" and 16450 - "Grounding."
1.4 SUBMITTALS

B. Shop Drawings: Detail equipment assemblies indicating dimensions, weights, loads,
required clearances, method of field assembly, components, and location and size of
each field connection.
1.5 QUALITY ASSURANCE
A. Installer Qualifications: Manufacturer's authorized representative who is trained and
approved for installation of units required for this Project.
I. Maintenance Proximity: Not more than four (4) hours' normal travel time from
Installer's place of business to Project site.
2. Installer is required to have a minimum of five (5) years installation experience of
this type of equipment.
B. Testing Agency Qualifications: An independent agency, with the experience and
capability to conduct the testing indicated, that is a member company of the
InterNational Electrical Testing Association or is a nationally recognized testing
laboratory (NRTL), and that is acceptable to authorities having jurisdiction.
I. Testing Agency's Field Supervisor: Person currently certified by the
InterNational Electrical Testing Association or the National Institute for
Certification in Engineering Technologies to supervise on-site testing specified in
Part 3.
1.6 PROJECT CONDITIONS
A. Interruption of Existing Electrical Service: Do not inten'upt electrical service to
facilities occupied by Owner or others unless permitted under the following conditions
and then only after arranging to provide temporary electrical service according to
requirements indicated:
I. Notify and schedule with the Clinical Manager and Project Manager no fewer
than seven (7) days in advance of proposed interruption of electrical service. No
interruptions during facility operating hours.
2. Do not proceed with interruption of electrical service without Owner's written
permission.
1.7 COORDINATION
A. Contractor shall schedule all work hours, shutdowns, and use of facility with the
Clinical Manager and Project Manager.
B. Coordinate size and location of concrete bases for package engine generators. Cast
anchor-bolt inserts into bases. Concrete, reinforcement, and formwork requirements are

1.8 WARRANTY
I. Contactor shall warranty the installation for a period of one (I) year from date of
Substantial Completion of installation or hand over to the owner, whichever
comes later.
1.9 MAINTENANCE SERVICE
A. Initial Maintenance Service: Beginning at Substantial Completion, provide twelve (12)
months' full maintenance by skilled employees of manufacturer's designated service
organization. Include quarterly exercising to check for proper starting, load transfer,
and running under load. Include routine preventive maintenance as recommended by
manufacturer and adjusting as required for proper operation. Provide parts and supplies
same as those used in the manufacture and installation of original equipment.
B. Provide separate price for this item of work.
PART 2 - PRODUCTS
2.1 MANUFACTURERS
A. Manufacturers: Subject to compliance with requirements, products by one of the
following manufacturers will be supplied:
I. Caterpillar; Engine Div.
2. Kohler Co.; Generator Division.
3. Magnetek, Inc.
4. Onan/Cummins Power Generation; Industrial Business Group.
2.2 ENGINE-GENERATOR SET
A. Factory-assembled and -tested, engine-generator set.

2.4 FUEL OIL STORAGE
I. The generator will be supplied with base-mounted fuel oil tank.
2.5 CONTROL AND MONITORING
A. As indicated on the manufacturer's submittals.
PART 3 - EXECUTION
3.1 EXAMINATION
A. Examine areas, equipment bases, and conditions, with Installer present, for compliance
with requirements for installation and other conditions affecting packaged engine-
generator performance.
B. Before performing any work to the exterior of the building or performing any site work,
the contractor must contact Dig Safe or whatever company is used to locate buried
services. Once the site is marked, contact FMC's Project Manager to obtain go ahead.
FMC's Project Manager will be responsible for contacting the leasing department and
ensuring that the lease has been amended if required and landlord approval is obtained
before site work or any cosmetic changes are made to the property. Exact location of
generator and routing of conduits will also be part of this confirmation.
C. Examine roughing-in of piping systems and electrical connections. Verify actual
locations of connections before packaged engine-generator installation.
D.
Proceed with installation only after unsatisfactory conditions have been corrected.
3.2
INST ALLA TION
A.
Comply with packaged engine-generator manufacturers' written installation and
alignment instructions and with NFPA 110.
B.
Install packaged engine generator to provide access, without removing connections or
accessories, for periodic maintenance.
c.
Install packaged engine generator on concrete base. Use FMC's standard details for size
and thickness of the pad. Secure sets to anchor bolts installed in concrete bases.
Concrete base constlUction is specified in Division 16 Section "Supporting Devices."
D.
Electrical Wiring: Install electrical devices furnished by equipment manufacturers but
not specified to be factory mounted.

E. FMC-NA requires that a fused disconnect be installed on the line side of the Automatic
Transfer Switch (A TS) if there is no over current protection present. FMC also requires
a non-fused disconnect on the emergency feed from the generator as close as physically
possible to A TS for safety lockout purposes.
F. Contractor shall obtain diesel storage permits and relay any special requirements back
to the engine generator manufacturer. Contractor shall be responsible for the initial fuel
fill.
G. Excavate trench from point of entry to building or ATS over to generator pad location.
Trench shall conform to local building code requirements and repaired to existing
conditions.
H. Furnish and install steel concrete bollards per FMC-NA specifications.
I. Furnish and install necessary conduits and conductors for complete generator
installation, conduits to include but not limited to feeder from generator to A TS, start
circuit, power for charger and block heater, remote annunciator, and in some cases a
heater for the A TS housing.
J. Schedule and take delivery of generator. This shall include the offloading of the
generator at the site.
K. In some cases, other items may be required such as a fence, special barrier, or even
plantings as shown on contract drawings.
L. Site is to be cleaned and returned to original state after construction completion.
3.3 CONNECTIONS
A. Ground equipment according to Division 16 Section 16450 - "Grounding"
B. Connect wiring according to Division 16 Section 16120 - "Wire and Cables - 600Y and
Under"
3.4 IDENTIFICATION
A. Identify system components according to Division 15 Section "Mechanical Materials
and Methods" and Division 16 Section "Special Provision for Electrical Work."
3.5 FIELD QUALITY CONTROL AND START-UP
A. Once start-up checklist is completed (see Section 01200 - Project Meetings) and faxed
or e-mailed to the generator manufacturer and FMC Project Manager, contact the
manufacturer to schedule start-up. During the start-up, contractor and FMC facility

Double-Wall Subbase Tank, Type 1
. The above-ground rectangular secondary
containment tank mounts directly to the generator
set, below the generator set skid (subbase).
. The secondary containment generator set base
tank meets UL 142 requirements.
. Both the inner and outer tanks have emergency
relief vents.
. The containment tank's double-wall construction
protects against fuel leaks or ruptures. The inner
(primary) tank is sealed inside the outer (secondary)
tank. The outer tank contains the fuel if the inner
tank leaks or ruptures.
. The generator set is designed to comply with the
installation standards of NFPA 30 and NFPA 37.

when equipped with the necessary accessories and
installed per NFPA standards.
. The generator set complies with ISO 8528-5,
Class G2, requirements for transient performance in all
generator set configurations. Select the
Decision-Maker '" 550 controller for improved voltage
regulation and ISO 8528-5, Class G3, compliance.
. The 60 Hz generator set engine is certified by the
Environmental Protection Agency (EPA) to conform to
Tier 3 nonroad emissions regulations,
. A one-year limited warranty covers all systems and
components. Two-, five-, and ten-year extended
warranties are also available.
. Alternator features:
o The unique Fast-Response '" II excitation system
delivers excellent voltage response and short circuit
capability using a permanent magnet (PM)-excited
alternator.
o The brushless, rotating-field alternator has
broad range reconnectability.
. Other features:
o Controllers are available for all applications. See

o The low coolant level shutdown prevents
overheating (standard on radiator models only).
o Integral vibration isolation eliminates the need for
under-unit vibration spring isolators.
RATINGS: All three-phase units are rated at 0.8 power factor. All single-phase units are rated at 1.0 power factor. Standby Ratings' Standby ratings apply to instaJlations served by
a reliable utility source. The
standby rating is applicable to varying loads forthe duration of a power outage" There is no overload capability forthis rating. Ratings are in accordance with 180-3046/1, B8 5514, A8
2789, and DIN 6271. Prime
PowerRatmgs: Prime power ratings ap~y to instaJlatlons Where utility power IS unavailable or unreliable. At varying load, the number of generator set operating hours is unlimited. A
10% overload capacJty is
