EXPLANATION OF THE NATURE OF THE APPLICATION
This is a request to allov for the construction of a removable addition, consisting
of a dining room and an office, to the currently constructed modular RCF partially
vi thin the right-of-vay dedicated to the City as part of the' approval of the
original Site Plan in 1988. The addition is 14' vide by 28' long. Approximately 9'
by 28' vill extend into the public right-of-vay.
This request is a modification of a Site Plan Modification granted in 1989 (Jo. No.
89-02-89) vhich modified the original Site Plan approval granted in 1988 (Jo. No.
88-08-126). The 1989 modification called for the installation of additional
landscaping, a movable fence and gate and an movable deck and hand rail as .approved
through a Use Permit and Agreement dated January 28, 1988.
DECISION
Preliminary Site Plan Modification Approval vith conditions, as of the ~ate of this
letter. Vhen the conditions attached to this request have been met, Final Site Plan
~proval vill be granted. PRELIMINARY APPROVAL EXPIRES 90 DAYS FROM THE DATE OF THIS
LEITER.

SITE INFORMATION
The property is located at 5706 Daisy Street (Assessor's Map 17-02-33-44, Tax Lot
1601). The property flat and is developed vith an existing residential care
facili ty. The property is zoned Medium Densi ty Residential (MDR) and is designated
Medium Densi ty Residential in the Metro Plan. Residential care facili ties are a
permitted use in the MDR District.
CRITERIA OF APPROVAL
(Ref. Section 31.100 of the Springfield Development Code)
There is no specific criteria of approval for a modification of a Site Plan. Section
31.100 requires the applicant to explain the modification.
The applicant has stated that this is a request to "construct a removable addition to
the currently constructed modular RCF vi thin the right-of-vay area previously
approved 1989."
There are tvo issues vhich need to be addressed as part of the approval of this
reques t:
1. A nev or modified right-of-vay use agreement must be prepared, signed and
recorded at Lane County at the applicant's expense. The previous use agreement
permi tted only parking and landscaping in the public right-of-vay; this reques t
is for a portion of a building in the public right~of-vay.
2. The original approval in 1988, alloved for a 5 foot-vide setback betveen the care
facility and the property line abutting the right-of-vay dedicated to the City.
Rather than go through a variance procedure for the setback, the signing and
recording of a deed restriction vaiving the setback vill be required.
VHAT NEEDS TO BE DONE TO OBTAIN FINAL SITE PLAN APPROVAL?
1. The plan submitted vill be considered the Final Site Plan.
2. A nev or modified right-of-vay use agreement must be prepared, signed and
recorded at Lane County at the applicant's expense.
3. The signing and recording a t Lane Co un ty at the applican t' S expense of a deed
restriction vaiving the 5 foot setback.
4. A Development Agreement vill need to be signed. This document vill be prepared
by staff upon receipt of the recorded documents.

APPEALS
This Modification of a Site Plan is considered a decision of the Director and as such can
be appealed to the Planning Commission. The appeal may be filed by an affected party vith
the Development Services Department vi thin 10 calendar days of the date of this decision.
