At all times herein Defendant LarI)' Dilbeck has been. in
3 business as 'a .general residential contractor in Lane County,
4 Oregon, doing business as Larry Dilbeck construction.

6 During the summer of 1994, Defendant Dilbeck built a residence
7 on a lot immediately ._~djacent 'to Plaintiffs' home, with a street
8 address of 7251 Daisy street, springfield, Oregon.

10 Defendant c~ty of Springfield was the prior owner of such lot
11 and was or' should have been aware of its configuration and

unsuitability for construction without measures being taken to
ensure that ,such construction, did not impair ~he natural drainage
in the area, 'including the drainage of Plaintiffs' lot.

Defendant Dilbeck 'also knew or should have known of the need
,to ensure that the residence being built by him needed to be
constructed in such a fash~on as not to. impair the natural drainage
in the area, including the drainage of Plaintiffs' lot.

As a direct and proximate result of the construction of the
residence at,7251 Daisy street and the negligence of Defendants,as
set forth ~elow, Plaintiffs': ~esid~nce has been 'flooded on several
occasions since December, 19~4 and continuing until November, 1996,
all to Plaintiffs' damages in an amount exceeding $10,000.00.

Once Plaintiffs' damages ar,e known with more, certainty this
complaint will be :amendedto allege such sum. ,

Defendant City of Springfield,was'neg~igent in one or more of
the following particulars:'
A. In pe~itting constrUction of the subject residence by
Defendant Dilbeck without considering the effect on Plaintiffs'
property.
B. In not, requiring' Defendant :Di1beck to provide for
continued adequate drainage from Plaintiffs' property.
C. In allowing pefendant Dilbeck ,to fill the natural
drainage as part of his construction project.

Defendant. Dilbeck was negligent in one or more l?f the,
following particulars:
A. In constructing a residence on, the subj ect '. property
without considering the effe~t on Plaintiffs' property.
B. In not providing for continued, adequate drainage from
Plaintiffs' propert~.
