Below you will find our response to SDC 5.] 9-125, so as to demonstrate compliance with the Tree Felling Permit criteria. 19-125 Criteria The Director, in consultation with the Public Works Director and the Fire Chief shall approve, approve with conditions or deny the request based on the following criteria: A Whether the conditions of the tress with respect to disease, hazardous or unsafe conditions, danger or falling, proximity to existing structures or proposed construction, or interference with utility services or pedestrian or vehicular traffic safety warrants the proposed felling. D In the event that no Development Plan has been approved by the City, felling of trees will be permitted on a limited basis consistent with the preservation of the site's future development potential as prescribes in the Metro Plan and City development regulations, and consistent with the following criteria. 1. Wooded areas that will likely provide attractive on-site views to occupants of future developments shall be retained; Does not apply. 2. Companies affected by the new guidelines include Chicago Title Insurance Company, Chicago Title Insurance Company of Oregon, Commonwealth Land Title Insurance Company, Fidelity National Title Insurance Company, Lawyers Title Insurance Corporation and Ticor Title Insurance Company, as well as all agents underwritten by one of these companies. "Early Issue" coverage refers to the elimination of the construction lien exception from a title policy before the expiration of the statutory lien period. This period ends 75 days after the completion of the project. The completion date is usually evidenced by the recording of a "Notice of Completion". Title companies have long considered this coverage as a special risk requiring more cautious underwriting procedures.
