LAND USE REQUEST Simply put, this is an application request for a Planning Director determination that the proposed use does not represent a "change of use" as that term is defined in the Springfield Development Code (SDC) and that, therefore, the application does not need a Minimum Development Standards (MDS) application approval to engage in the proposed use on the subject property. The applicant also requests that, pursuant to SDC 5.15-115.A, the Planning Director exercise his discretion to review this application under the Type II review process. The purpose of this request is to ensure certainty to the applicant, through a forn1alland use decision, that it will be permitted to use the property as proposed and as needed to operate its business. In Recovery House VI v. City of Eugene, 150 Or App 382, 387-88, 946 P2d342 (1997), the Court of Appeals held that an applicant was entitled to request, as part of a land use application, whether that application was even necessary and was entitled to a determination by the local government to that question, even if the City ultimately approved the application. The MDS application is applicable when there is a proposed expansion in building gross floor area and/or impervious surface area or a change in use of a building or property. SDC 5.15- 110.A. The applicant is not requesting any changes to the existing development on the site. Furthermore, the applicant believes that the proposal does not represent a change of use from the former Reed's Fuel & Trucking operation. Consequently, an MDS application is not needed in this instance. Under Recovery House VI, the MDS application is the process by which the City can make a determination that an MDS application is not needed. SDC 6.1-1 lO defines "change of use" as: "A change from one existing permitted to another pern1itted use in the applicable zoning district." The express language of this provision identifies changes in uses permitted "in the applicable zoning district" as representing a change of use. Each zoning district has a schedule ofpern1itted uses; in this case the Schedule of Light Medium Industrial, Heavy Industrial and Special Heavy Industrial Use Categories listed at SDC 3.2-140. The schedule at SDC 3.2-140 identifies 82 separate uses under 8 different use categories. Given the text of SDC 6.1-110 and the context of the schedules, a "change of use" occurs when an applicant proposes a use for a property or building that represents a change from one listed use to a different listed use. If an applicant proposes a use for a property or building that is identified by the same use description in the table, the applicant does not propose a "change of use. " Here, the applicant seeks to continue the same permitted "automotive and heavy equipment repair and service including the recapping and retreating of tires" use that the Reed's Fuel & Trucking operation had on the property previously. As the aerial photograph from the 2008 Lane County MetroPlan area aerial survey shows (Exhibit A), the property included the same office/terminal building, large vehicle shop, wash area and outdoor fueling station during the Reed's Fuel & Trucking operation as currently exist on the property. See Exhibit B, Site Photographs. Exhibit A also shows a large number of vehicles of different types in the graveled repair yard/parking area. Reed's Fuel & Trucking utilized a range of vehicle types to include: 5,6, and 7 axle tractor/semi combination chip trucks; front end loaders; 8 axle dump truck combinations; 40- foot semi flatbed trucks; 40/20- foot maxi combinations; lowboys; and curtain vans. The structures and uses shown on Exhibit A demonstrate that the Reed's Fuel & Trucking operation was a permitted "automotive and heavy equipment repair and service" use in the Light Medium Industrial Zone. The large vehicle shop will be used for service and repair of vehicles and heavy equipment. The fueling and wash areas will be used for those same purposes. The nature of the BJ Equipment use will remain the same as well- the repair and servicing ofa range of wheeled and tracked heavy equipment. While types of trucks and heavy equipment serviced may differ slightly with the BJ Equipment use, the on-site and off-site impacts of the proposed BJ Equipment use are identical to those from the Reed's Fuel & Trucking use. That use is consistent with the "automotive and heavy equipment repair and service" use listed in the SDC 3.2-410 use schedule. Consequently, the Planning Director should conclude that the proposed BJ Equipment use of the subject property does not represent a change of use from the former Reed's Fuel & Trucking operation and that the applicant is not required to obtain a Minimum Development Standards approval before beginning operations on the property. II. SITE CONTEXT Because a range of detail about the site and adjacent property are discussed below in the response to the checklist items, this section provides a more general description of the site context. The subj ect property is a triangular-shaped parcel fronting Commercial Avenue at the intersections with 40th and 41 st Streets. See Exhibit A. The property is generally broken down into two areas. The northwest corner has a two-story office/terminal building with a paved driveway, landscaping and lawn. The eastern portion of the property is entirely graveled and contains a range of structures to include: a large shop building; an above-ground fuel tank; several sized storage buildings; and a vehicle wash area. See Exhibits A, B. The service and repair area has no trees or other significant natural vegetation. The property is planned and zoned Light Medium Industrial. See Exhibits C and D. Surrounding properties are a mix of industrial, commercial and residential zoning districts and include a range of uses, from mini-storage facilities, to multifamily housing and a church. See Exhibit B. III. APPLICATION WRITTEN EXPLANATION CHECKLIST ITEMS The checklist items are presented in bold italics below, with the applicant's responses following in plain text. Project Name. BJ Equipment Company LLC Automotive and Heavy Equipment Repair and Service Project Size and location of property. The project is located at 4080 and 4100 Commercial Avenue in Springfield at the site of the former Reed's Fuel & Trucking operation. See Exhibit A. The property is identified as Tax Lot 4300, Map 17-02-31-14. See Exhibit E, Assessor's Map. Zoning and plan designation of the site and adjacent properties. The property has a Light Medium Industrial MetroPlan designation and a Light Medium Industrial zoning district. See Exhibit C, Excerpt of Metro Plan Diagram, and Exhibit D, Excerpt of Zoning Map. The smaller-lot properties to the immediate north are planned and zoned Heavy Industrial and are in industrial use. Properties to the immediate east are planned Commercial and zoned Community Commercial. That property is currently in mini-storage use with corrugated buildings similar to the shop building on the subject property. To the southwest, properties are planned and zoned Medium Density Residential. Directly across Commercial Avenue is a vacant field and then a multi-family development. North of the vacant field is the East Side Baptist Church. And on the northwest comer of the property are properties planned Light Medium Industrial and Medium Density Residential, and zoned a mixture of Light Medium Industrial, Medium Density Residential and Low Density Residential. Proposed use of the development area and scope of proposed development. BJ Equipment Company LLC proposes to use the subject property to service and repair its fleet of tmcks and heavy equipment to include semi tmcks, dump trucks, and other wheeled and track heavy equipment that are used in off-site constmction, drilling and blasting operations. No new development is proposed for the property. The applicant seeks to continue the historic automotive and heavy equipment repair and service use of the property established by Reed's Fuel & Tmcking. The applicant will use the same buildings and other stmctures on the property in the same manner they were previously used. The applicant will not be expanding any building or adding any impervious surfaces to the property. Access The subject property has multiple access points onto Commercial Avenue, which connects to 42nd Street and to 30th Street at its ends. The office building has a separate access point onto Commercial Avenue than the one for the repair and service facilities. Proposed off-site improvements. The applicant is not proposing any off-site improvements with the resumption of the permitted use. Current use of the site and any existing improvements. The property is currently not in use. All on-site business activities were terminated at the end of August 2009. The most recent use on the property was the Reed's Fuel & Trucking operation discussed above. . . . . . Existing improvements include: an approximately 5,600 square-foot office/terminal building located on the northwestern portion of the property; an approximately 9,600 square-foot vehicle shop building located near the southern end of the property; a 1,600 square-foot storage building and a 700 square-foot shed located along the eastern property line to the northeast of the vehicle shop building; a l5,000-gallon above ground diesel fuel tank, inside a containment vault, located approximately 75 feet to the east of the northeast comer of the vehicle shop building; a truck washing station on the center of the property; a drain field for the truck washing station and two shallow troughs to collect wash water and storm water runoff that directs water to two-stage sediment-trap catch basins located approximately 80 feet on either side of the entrance to the truck repair and service facility. Several above-ground and below-ground fuel tanks that were previously located on the property have been removed in the years between 1989 and 2009. Special site features (i.e. wetlallds, watercourses, steep slopes, etc.)' a gelleral statemellt assessillg soil type alld draillage cOllditiolls. The subject property is generally flat with no wetlands or steep slopes. There are no natural watercourses on the property. As discussed above, there are two shallow troughs that collect wash and stormwater runoff from the property. A stormwater drainage way runs along Commercial Avenue between the property and that road. See Exhibit B, Site Photos. The soils consist of Oxley-Urban Land Complex (95%) and Coburg-Urban Land Complex (5%), which are beneath packed gravel overlay on the portions of the property that have been subject to heavy'equipment service and repair use. The soils were formed from gravelly alluvium and contain gravelly-clay loams to a depth of approximately 3.5 feet, and then gravelly sandy loam to 5-foot depth or more. These soils typically have permeabilities that are classified as slow, and are poorly drained. The on-site soils are underlain by Older Alluvium from approximately 6-6.5 foot depth to more than 300-foot depth. The groundwater table typically ranges between six and ten feet below the surface in the area around the subject property. The Oxley soils can also support perched water tables, in the range of 0.5 - 1.5 feet below ground surface from November through May of each year. The regional hydrological gradient (direction of groundwater flow) ranges from west northwest to northwest in the area of the subject property. Estimated qualltities alld type of materials illvolved if allY fill or excavatioll is proposed. No fill or excavation is proposed. The applicant intends to use the property for the same uses it has been put to in recent years and does not propose any physical development on the property. CONCLUSION For the reasons provided above and based on the evidence submitted into the record, the Planning Director should conclude that the proposed BJ Equipment use of the subject property does not represent a "change of use" from the former Reed's Fuel & Trucking operation, that the proposal does not request an addition or expansion of building gross floor area and or impervious surface and, therefore, that the applicant is not required to obtain a Minimum Development Standards approval before beginning operations on the property.
