Please Refer to Our File: 15457-66 Ladies and Gentlemen: This office represents Hamilton Construction Co. CHamilton") and Rosboro, LLC CRosboro"). Rosboro currently owns the property subject to this DIM located at 28th Street and south of F Street, Map 18-02-06-00, Tax Lot 1004 (the "Subject Property"). The Subject Property is approximately 7.38 acres and is currently used by Rosboro as a log yard. Rosboro desires to sell the Subject Property to Hamilton by the end of August 2010. Hamilton desires to purchase the Subject Property and use it for the outdoor storage of wood and steel construction material used in the construction of bridges as part of its normal construction business operations (the "Proposed Use"). No structures would be proposed on the Subject Property at this time. The Subject Property is currently zoned Heavy Industrial (HI) and is designated by the Metro Plan as Commercial. In addition, the Subject Property has been proposed to be designated Light Medium Industrial under the draft Springfield 2030 Refinement Plan (the "SRP"). Hamilton and Rosboro both wish to receive confirmation from the City that such a use is a permitted use under the current land use regulations and that such a use would continue to be permitted should the SRP designate the Subject Property as Light Medium Industrial. Question I. Is the Proposed Use permitted in the HI zone? Question 2. Is the Proposed Use permitted in the Community Commercial, CC zone? Question 3a. If the Proposed Use is permitted in the HI zone, and the Subject Property is designated Commercial by the Metro Plan Designation, is the Proposed Use still allowed under this plan/zone "conflict"? Question 3b. Similarly, if the Proposed Use is permitted in the HI zone, and the Subject Property is redesignated Light Medium Industrial by the SRP, would the Proposed Use still be permitted under this "new" plan/zone "conflict"? Question 4a. If the Proposed Use is not permitted in the HI zone, but is permitted in the CC zone, does the fact that the Subject Property is designated Community Commercial, CC permit the Proposed Use? Question 4b. Similarly, if the Proposed Use is not permitted in the HI zone, but is permitted in the Light-Medium Industrial (LMI) zone, would the Proposed Use be permitted if the Subject Property is designated Light Medium Industrial? Question 5. Is site plan review required for the Proposed Use (i.e. no structures proposed, rather just outdoor storage of material to construct bridges)?
