A site plan is being submitted with this zone change request. '" The Chairman commented that. the area under consideration was quite low in elevation. Mr. Richard Unruh, an architect living at 3225 Filmore, Eugene, was present and exp1ained that this request was a part of 1l0peration Breakthrough'l and would require approval on a number of levels before development could proceed. Mr. Micky Duke, 363 Lindale, stated that he had looked into this type of develop- ment' and stated that HUD does not have adequate site plan review in these matters, asking that the Commission keep this in mind when considering this request. The Chairman asked Mr. Mayer about some of the questions raised'by Mr. Duke; Hr, Hayer replied that the City can only require compliance with Building Code restrictions. Mr. Clare Hedien,1l66 West Centennial, said both he and his neighbor, Hr. Dickerson, 1142 West Centennial, were concerned about permanently losing access to the back of their properties. The Secretary suggested that possibly Hr. Unruh and 'Hr. Hedien and Mr. Dickerson could work together to prevent such a Illand-lockedll situation. No one else spoke on this matter, and the public hearing was closed. Hr. Bates stated that he preferred to table this item for the present. Mr. Cole said he could not . -- ,see having to stymie future development if the neighbors could not work out a cooperative solution. Hrs. Privat indicated she would deny the request, as did H)~. Wood. Mr. Rosenberg asked about ownership and '''as, told it W?S private rather than government. He also inquired if a site' study had been made, and Hr. Unruh replied that HUD had looked at the area and he outlined the points they had required. It was pointed out that that there would be a potential' of a number of children in the development. Hrs. Lawson, 220 S; 51st, asked if there was transportation to this arei. It was stated that it is served by city bus. Motion: It was moved by Mr. Wood, seconded by Mrs. Privat to deny this request. Motion passed by a vote of four to one, with Mr. Rosenberg,voting "noli. The Chairman declared a recess at 9:00 p.m. The meeting was reconvened at 9: 15 p. m. Steve Smith (Journal No. S-7l-66)--Continued Item Located on the west side of South, 51st' Place south of Main Street and north of the Weyerhaeuser logging road. The property proposed for subdivision contains 20.3 acres. Proposed subdivision contains 77 lots and would be utilized as a low density Planned Unit Development. Preliminary approval. The Chairman reiterated the need to consider this item once more, stating that it had been'found that point 5 as required in, the original Planning Commission approval was not legal and valid. Mr. Steve S~ith and Hr. Stan Smith were both present. Steve Smith restated their intention to improve S. 51st Street to a 20 foot width, with a 36 foot wide entrance off of Main Street. ~ Mr. Walter Roberts, 265 S. 51st Place, asked what the figures were at the present time. A discussion ensued; howeve,r, the. Chairman pointed out once again that the City could not require the Smiths to. de.velop a fully improved street. Mrs. Joseph Lawson, 220 S. 51st Street, asked when their street would be posted to ' prohibit truck traffic, as she had also requested at a Council meeting. The Chairman informed her that the City would be reminded of her request. l-trs. Privat said she would recommend denial and felt this should be a straight subdivision. ' Mr. Bates said he favored the PUD because it was better for the future, and the Smiths' proposal' would provide a better street than the one presently available, even if it lasted no more than five year~. Mr. Cole said he agreed with Mr. Bates and was not impressed with people who decried the unimproved streets but did not wish to pay for them. Mr. Hood stated that if denied, the Commission \IIould be giving a "license" to a housing project, whe~eas, if approved, the City \IIou1d be gettin.tJ a PUD \IIhich he felt would be somewhat better. A discussion of the PUD ensued. Mr. Rosenberg and Mr. Wood both stated that the best possibl~ way to secure access see~ed to be the main consideration, since it was apparent that some development was going to take place. Mr. Rosenberg asked the Secretary to read the four points reconmiended by the Planning Commission at the time the matter was referred to the City Council. "- Motion: At the conclusion of the reading, Mr. Bates moved to approve the resolution of intent with the following conditions: 1. That' final drawings are submitted and approved. This would include the recording of the subdivision and dedication to the public of all streets and public walkways. 2. That the maximum density allowed be 125 dwelling units. 3. That the development and maintenance of the proposed 3 acre park be provided for by acceptance by the Wtlla~a!ane Park District orby the establishment of a legitimate homeo\v~ers association that is duly incorpoiated with approved by-taws and provision for financing with a copy of the by-laws on file with the Planning Department. 4. That six months be allowed for start of construction. 5. That a time limit of three years from start of construction to completion be allowed. 6. That the Smiths construct a 20-footwide street (6" gravel, 2" asphalt mat), with a 36 foot wide entrance from Main Street on S. 51st Place. (The Smiths had pub,lic1y stated that they would construct a 20 foot side asphalt mat street to provide access to their development.) 7. That after. the houses on 51st Place are completed this, street and 50th Place and 51st Street will be closed to truck traffic; with 49th Place used exclusively for access. (The Smiths , publicly stated that they would utilize 49th Place for truck access during construction.) Page 107 .':w...... " r .,/. .' e Planning Commission Minutes Public Hearings: Steve Smith e There was some discussion of altering point two from 125 dwelling units to 118, but this was not done, as Mr. Steve Smith stressed that the 7 additional units were needed to cover the cost of the street access to Main Street. The motion was seconded by Mr. Cole and passed by a vote of three to two, with Mr. Wood, Hr. Cole, and Mr. Bates voting "yes" and Mrs. privat and Mr. Rosenberg voting II no" . 4. BUSINESS FROM THE AUDIENCE 5 . r " ~ Mr. Ardis Smith and Mr. Elmo Aldridge request the Planning Commission to con- sider the annexation of property they wish to develop in the Redwood Estates area south of the City. Upon Mr. Smith's reque~t, this item was deferred to'the next meeting. Hr. Alfred Allen requests the Planning Commission to consider the annexation of a large area located ,in the Willamette Heights area south of the City. Mr. Allen was not present and this item was not considered. Mr. Johnson stated that a petition to annex the Willamette Heights area would be submitted in the near future. RESOLUTIONS OF INTENT Ray Keen (Journal No. S-70-27) Located on the east side of Rainbow Drive between Centennial Boulevard and 'M' Street. The property is composed of a porti~n of one tax lot containing 41,325 ,square feet of land,' or just under one acre. ,The resolution calls for a zone change from RA Suburban District to R-3 Multiple Family Residential District subject to the following conditions: a. Approval of a site plan within six (6) months. b. Start of construction within one (I) year of site plan approval. ' A site plan has not yet been approved, and a six (6) month extension was granted on this resolution of intent in Jun~ of 1971. No one appeared in favor or against this request. The Secretary stated that the applicant had not been reached as he was out of town. Motion: It ~as moved by Mr. Bates, seconded by Mr. Wood, that the extension be allowed to lapse. The motion passed unanimously. M. P.
