A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD AMENDING
THE SITE PLAN REVIEW APPLICATION FEES OF THE DEVELOPMENT CODE, AND THE
MASTER SCHEDULE OF-FEES AND CHARGES, RATES, PERMITS AND LICENSES.
WHEREAS, the City has authority pursuant to Section 4 of the 2001 Springfield Charter and
Oregon Revised Statutes to establish fees and charges based on actual or average costs for providing
those services; and
WHEREAS, the .City has reviewed and considered the cost 'of Development Code Application
Fees for "Site Plan Review Impervious Charges" as .set forth in the Master Schedule of Fees, and
Charges, Rates, Permits, and Licenses; and
WHEREAS, the- Springfield staff and the Common Council has provided the opportunity for
public comment both informally and at a public hearing on July 19, 2010, prior to adoption of this
Resolution; and
WHERAS,..the Common Council has..undertaken and received a Study entitled Development Fee
Study and. Cost Recovery Strategy from the consulting firm of FCS Group, including Site Plan Review
Impervious Fees, which indicates in order to comply with Oregon law regarding fees for Applications for
Site Plan Review, it is necessary to reduce the Site Plan Review Impervious Fees.
WHEREAS, the Common Council has thoroughly reviewed the .Memorandum dated July 14,
2010, to. Gino Grimaldi from Jim Donovan regarding the Site Plan Review Impervious .Surface Fee
Reductions; and
WHEREAS; after review, public comment and consideration, the Common Council has
determined to reduce the site plan review impervious fees as specified in Section 1 below.
NOW, THEREFORE BE IT RESOLVED, by the Common Council of the City of Springfield as
follows:
1. The revisions to the fees for City of Springfield Development Code Site PlanApplication
Impervious Surface Charges as incorporated into the Springfield Master Schedule of Miscellaneous Fees
and Charges, Rates., Permits and Licenses, as more particularly described and highlighted on Exhibit A,
attached hereto and incorporated herein by reference is adopted. - ~ ~ .
2. Except as specifically amended in Section 1 above, all other rates, permit fees, licenses
and other fees and charges for the Springfield Master Schedule of Miscellaneous Fees and Rates, Permits
and Licenses shall remain in full force and effect.
3. That portion of the report titled Development Fee Study and Cost Recovery Strategy
from the consulting firm of FCS Group, and dated May, 2010, which specifically applies to site plan
impervious surface charges ~and~~setting forth the rationale for and= basis for the cost ofd Site Plan Review
Impervious Surface Fee is hereby incorporated by reference. - j
4. The Memorandum dated July 14, 2010, to Gino Grimaldi from Jim Donovan regarding
the Site Plan Review Impervious Surface Fee Reductions is hereby accepted and adopted as a finding in
support of this Resolution. .
5. Future Resolutions of the Common Council may be adopted to amend, add or delete a
permit fee, license fee, or other fee or charge:
6. In the event any rate, permit fee, license fee, fee or charge specified iin the Springfield
Master Schedule of Miscellaneous Fees and Rates, Permits and Licenses should be held invalid by
operation of law or any court of competent jurisdiction or the enforcement of any fee .restrained by such
court pending the final determination as to its validity, the remainder of the rates, permit fees, license
fees, fees and charges specified in the Springfield Master Schedule of Miscellaneous Fees -and Rates,
Permits and Licenses shall not be affected there by and shall remain in full force and effect.
7. This Resolution shall take effect on August 1, 2010.
This Resolution is adopted. by the Common Council and approved by the Mayor of .the City of
Springfield, Oregon this nineteenth day of July, 2010, by a vote of 5 for and 1 against. (Simmons )
