The investigation in this matter is now almost complete.
From that investigation it appears that we have reliable infor-
mation from past and present residents of your neighborhood
establishing that standing water has existed during the winter
months of the year in that area, including the McElvain's back-
yard, for a long time prior to the building of your home.
Based on this information, it woulQ"appear that the building
of your home had very little effect, 3f any, on the standing
water condition in the McElvain's backyard. We. feel we have a
good chance of defending the matter and have requested that
the court put this matter on the trial docket. We should be
receiving a trial date sometime during the middle of next year.

Since we are now approaching the winter months, I would
ask that both of you keep an eye' from time to time on the water
conditions in the MCElvain's backyard. I would be interested
ip knowing whether or not the improvements to the street have
,any effect on lessening th~ standing water problem. Your help.
