Applicant Response - taken from: written statement submitted with application 1/5/2009 Condition #1: Prior to plat approval, Parcels I, 2, and 3 shall be serviced with private sanitary sewer laterals from the IS-inch sanitary sewer main in the north of the subject property as depicted on the tentative plan in accordance with SDC 4.3-105 A. NOTE: Plumbing permits are required to install these private sanitary sewer laterals. Applicant Response: A copy of the building permit status report is included with this submittal as evidence of compliance with this condition. Staff Finding: Pending. These installations were done through an Encroachment Permit and verification is not provided on the Building Permit status report. Staff will confirm acceptability. of the sanitary sewer connections with the Public Works inspector prior to final plat. Condition #2: Prior to plat approval, Parcell shall be serviced with a private stormwater lateral from the existing stormwater lateral that extends through the subject property as depicted on the tentative plan in accordance with SDC 4.3-110 B. NOTE: Plumbing permits are required to install this private stormwater lateral. Applicant Response: A copy of the building permit status report is included with this submittal as evidence of compliance with this condition. Staff Finding: Satisfied. Condition #3: Prior to plat approval, the applicant shall document on the plat and record a private stormwater easement over the existing six-inch stormwater lateral that runs through the north of the subject property and is intended to serve both Parcels 1 and 2. Applicant Response: The easement is granted on the plat. Staff Finding: Satisfied. Condition #4: Prior to plat approval, the applicant shall verify the location of existing power lines in A Street, as well as the location of electric facilities that have been extended to all parcels. In addition, if it does not already exist, electric service shall be provided to Parcels I, 2, and 3 via the existing private joint utility easement running north/south in the center of the subject property in accordance with SDC 4.3- 120. Placement of such facilities shall be underground as conditioned in the Underground Placement of Utilities section below. Applicant Response: During construction of the other utilities, it was determined that all the parcels for this partition already have access to 2-]" and ]-2" power conduits that come from a ]-phase power line in 58th Street. Staff Finding: Not satisfied. SUB Electric advises that the conduit has been installed along the A Street frontage, but no underground electrical lines have been extended to the three parcels. Additionally, Parcel 3 is isolated from the electrical system and a utility easement may be required to extend service to this site. Applicant Response: During construction of the other utilities, it was determined that all the parcels for this partition already have access to 1-4" phone conduit, 1-2" cable conduit and 1-4" gas conduit that come from 58th Street. Staff Finding: Not satisfied. Although the conduits have been pre-installed, the utility lines have not been inserted. Condition #6: Prior to plat approval, the applicant shall verify the location of the existing water main in A Street, as well as the location of water facilities that have been extended to all parcels. In addition, if it does not already exist, water service shall be provided to Parcels 1, 2, and 3 via the existing private joint utility easement running north/south in the center of the subject property in accordance with SOC 4.3- 130. All water service facilities shall be installed per SUB Water standards. NOTE: Plumbing permits are required to install private water laterals. Applicant Response: During preparation of the tentative mapping, SUB provided our office with a map showing an 8" water main in the PUE on the south side of A Street. A copy of this map is included in this submittal. Connection to this water main can be made by future construction on Parcels 1 and 2 without disturbance to private or public facilities; therefore no connection needs to be made at this time for these parcels. A copy of the building permit status report is included with this submittal as evidence that Parcel 3 is supplied with a connection to the water main. Staff Finding: Not satisfied. The building permit status report does not indicate that water lines have been installed to serve Parcel 3. SUB Water advises that water lines have .not been connected to service the subject parcels. Water service to all parcels will be required prior to final plat. Condition #7: Prior to plat approval, the applicant shall provide a copy of a new approved OOOT access permit for the Main Street access. Applicant Response: A copy of ODOT's conditional approval letter is included with this submittal. Staff Finding: Partially satisfied. Although the ODOT access permit has been obtained, it appears the applicant has not yet complied with the conditions of the permit. Among the conditions of compliance, the driveway at the south end of Parcel 3 is to be physically restricted to a right-in/right-out turning movement. However, as present there is no signage, painted arrows, divider island or similar mechanism to physically restrict the turning movements. Condition #8: Vision clearance areas shall be maintained at each access to a public street as per SOC 4.2-130. Applicant Response: A note with this restriction is included on the plat. Staff Finding: Satisfied. , Heads Up Comments: 1. The existing bioswale at the south edge of Parcel 3 is in poor condition due to neglected landscaping, accumulated trash, and sediment infiltration. Maintenance and re-planting of this feature will likely be required to ensure it functions as intended. 2. SUB Electric may require an easement to provide electrical service to the parcels.. There is an existing transformer at the northeast corner of Parcel 2 that could provide t.':'';l"phase service. The plat pre-submittal meeting shall be held within one year of the date of the Land Division Tentative approval. A complete Land Division Plat application shall be submitted within 180 days of the pre-submittal meeting. If the applicant has not submitted the Land Division Plat application within these time frames, the Land Division Tentative approval shall become null and void and re-submittal of the Land Division Tentative application shall be required per SDC 5.2-140. Received: //J/~tJf / / Planner: AL 40f6 Land Division Plat APPIi!ion Process (see next page for a d!am of this process) ; 1. Applicant Submits a Land Division Plat Application for Pre-Submittal . The application must conform to the Land Division Plat Pre-Submittal Requirements Checklist on pages 5 & 6 of this application packet. . The purpose of pre-submittal is to ensure the applicant has all items necessary for a complete submittal. . A pre-submittal meeting to discuss completeness is mandatory. . Pre-submittal meetings are conducted every Tuesday and Friday, from 10:00am - noon. . We strive to conduct the pre-submittal meetings within five to seven working days of receiving the application. 2. Applicant and the City Conduct the Pre-Submittal Meeting . The applicant, owner, and design team are strongly encouraged to attend the pre- submittal meeting. . The meeting is held with representatives from Public Works Engineering and Transportation, Community Services (Building), Fire Marshall's office, and the Planning Division. . The meeting is scheduled for 30 to 60 minutes. . The Planner provides the applicant with a Pre-Submittal Checklist at the end of the meeting specifying the items required to make the application complete if it is not already complete. . The applicant will then have 180 days to make the application complete for submittal and acceptance by the City. 3. Applicant Submits a Complete Land Division Plat Application . When the applicant has addressed all items on the Pre-Submittal Checklist and the City Surveying Section has notified the applicant's surveyor that the plat and other documents are sufficiently refined, the applicant can submit a complete application to the City Survey Section located in the NW Quad of City Hall. . The application must conform to the Land Division Plat Submittal Requirements Checklist on page 6 of this application packet. . If the submittal is deemed complete, the City Survey Section will sign-off on the City Survey approval sheet and send the applicant to the Development Services Department for application submittal and fee collection. . Planning staff checks and signs the mylars. 4. Applicant Records Plat at Lane County & Submits Plat and Documents to City . After Planning staff checks and signs the mylars, the plat may then be recorded by the applicant's surveyor at Lane County. . After plat has been recorded at Lane County, applicant submits five (5) recorded, rolled paper copies of the plat and three (3) copies of required documents to the Development Services Department prior to the issuance of building permits. LAND DIVISION PLAT APPLICATION PROCESS 'i Applicant submits land division plat application for pre-submittal (See Land Division Plat Pre-Submittal Requirements Checklist) City departments review application for completeness and hold pre-submittal meeting to discuss completeness issues with applicant and applicant's representatives. ~ ~ Applicant addresses incomplete items. City Surveyor checks application and returns comments to applicant's surveyor. Once no errors appear on the plat and a current title report is submitted, applicant's surveyor is given ok to submit complete land division plat application. After ok given from City Surveyor and applicant has addressed all incomplete items from --- pre-submittal, applicant submits complete application to the City Survey Section (See Land Division Plat Submittal Requirements Checklist) City Survey Section signs-off on City Survey approval sheet and sends the applicant to the Development Services Department for application submittal and fee collection. Planning staff checks and signs mylars and notifies applicant's surveyor of approval. I Applicant takes plat and accompanying documents to Lane County for recording.
