I ',I ., , It has been brought to the City of Springfield's attention that the coffee kiosk is open for business. '" ~ ' ~. ) This project was approved,' with conditions, on March 18, 2008. The Development Agreement was signed imd'dbtarized by you on April 25, 2008. By signing this Agreement, you agreed with the conditicir;sset forth to allow the project to move forward. On August 22, 1008, at your request, a'site visit was conducted to ascertain compliance with the approved site plan. Staff observed that the conditions of approval had not been met. You were advised of the project status the afternoon of the nnd when you met with Molly Markarian and I at the counter. ,; Section 5.17-140.C states that no building or structure shall be shall be occupied until all improvements are made as specified in this Section. This means that the business will not be allowed to operate until such time as all Conditions of Approval are met and a final site inspection made. Section 5.17-150 requires all improvements to be installed prior to occupancy. In addition, a Certificate of Occupancy cannot be issued without Planning Department signoff. You are hereby notified that all business activity at this location shall cease until such time as the conditions of approval are met. Failure to comply within seven (7) days will leave us no choice but to initiate code enforcement action. ' Thank you for your prompt response to this matter.
