CITY OF SPRINGFIELD BALLOT MEASURE 37 INITIAL NOTICE (SMC 2.942) DATE: April 2, 2007 JOURNAL NUMBER: LRP 2006-00035 APPLICANT: Barbara Parmenter NATURE OF THE APPLICATION: Ballot Measure 37 Demand for Compensation EXPLANATION: Springfield Municipal Code (SMC) 1997, Sections 2.900 through 2.995, implements Ballot Measure (BMP7 which was approved by the voters of the State of Oregon on November 2, 2004. BM 37 amended Oregon Revised Statutes Chapter 197 to require, under certain specific circumstances, payment of compensation to the present Owner of real property if government land use regulations reduce fair market property value. BM 37 provides that in order to receive compensation, the present Owner must make a written "Demand for Compensation" to the City. The City then has 180 calendar days to either: approve payment of compensation; modify, remove or not apply the land use regulation causing the alleged reduction in fair market value instead of payment; or deny the Demand. BASIS OF THE DEMAND: The applicant states the basis of the Demand is as follows: The applicant , owned the property approximately 7 years prior to the City's establishment of a review process for a Tree Felling Permit. Initially, there was no permit fee. The applicant has since applied for City approval of the first phase of a subdivision of the property. As a condition of Tentative Plan approval, the applicant was required to submit an application for a Tree Felling Permit. The Tree Felling Permit process, today requires an application fee. . AMOUNT OF COMPENSATION SOUGHT: The applicant estimates that Tree Felling Permit fees are $15,000.00 and that consultant's fees to comply with the provisions of Springfield Development Code (SDC) Article 38 are $10,300.00. The total amount of compensation sought is $25,300.00. THE REGULATION/S) THAT CAUSES THE COMPENSATION TO BE ALLEGED TO BE DUE: Tree Felling Permits are regulated by SDC Article 38 and the current Development Code fee schedule, which is adopted by resolution.
