Gino & Bill: I have spoken with Jim and the generic comments about elections in general have been addressed. Since
this is an election year, we wanted to ensure the ordinance and staff report specifies that the annexation is effective 30
days after signature by the Mayor OR after State acknowledgement, whichever is later.
Regarding the Lane County comments, it is not the City's current policy to annex streets that have not been fully
improved (or at least have improvements assured through an annexation agreement). There is the possibility that only
the portion of 19th Street subject to annexation will be improved, and not the portion south to Yolanda Avenue. When
and if the properties fronting onto the southern portion of 19th Street annex, the City can obtain frontage improvements
and annexation will be warranted. Staff will continue the dialogue with Lane County Transportation when the adjoining
residential property to the west is developed.

OK: added language in the staff report about confirming the legal description with the state DOR to ensure there are no
gaps or overlaps between current and projected City Iimts, and a sentence about the ordinance becoming effective 30
days after signature by the Mayor or upon final acceptance by the state, whichever is later. Should be good to go! Now

Item 1: we should use the "or upon acceptance by the state" language in the staff report and ordinance and be ready for
questions;-)
Item 2: The language accounts for the surveying degrees that can create minute gaps in anything and should be used
generically in all of our descriptions or in the ordinance so we don't have to go back if DOR or future refinements in
technology find a sliver;-)

You're right, it might be too close to the election for it to go through. But, the ordinance does mention 30 days after
second reading and adoption by Council or acceptance by the State, whichever is later. I'll check on the closing the gap
language - right now the City limits are along the west boundary so hopefully there shouldn't be any gaps in the legal
description, but you never know...

Andy,
Two questions:
1) Do we have the intent statement in the description to the effect that we intend to close all gaps between the
existing city limits and the annexation area? I couldn't find it?
2) Should the effective date discussion of the staff report and ordinance reflect the fact that there is a bond
election pending? We may need to review that part of the code.
That's it, let me know your thoughts and/or revisions before it goes up.
