HomeMy WebLinkAboutResolution 10-45 07/06/2010 RESOLUTION No. 10-45 / A RESOLUTION ACCEPTING AN OFFER FROM SPRINGFIELD CHURCHOF THE BRETHREN FOR NON- MONETARY CONSIDERATION OF CITY OWNED SURPLUS PROPERTY WHEREAS, by Warranty deed recorded September 1929, in Reel 605R, Reception No. 20440, on Page 480, Vol. 14, Lane County Official Records in Lane County, Oregon, the City of Springfield (aka. the "Town of Springfield"), acquired a certain parcel of property that is known as a portion of Main Street (aka "McKenzie Highway"), as show on Tax Assessor's Map 17033541, located in Lane County as described in above said deed, attached as Attachment 2, (the "Property") of which exists a surplus portion not being used by the public, as more particularly described in the attached Attachment 3; and WHEREAS, said parcel was acquired from Paul and Pearl Hadley in fee simple absolute, and was therein dedicated to the public; and WHEREAS, a portion of the Property is no longer needed for public purposes; and WHEREAS, the City Council has declared the property as Surplus and a remnant which is not needed for public use; and WHEREAS, pursuant to ORS 271.310, the City is authorized to sell or otherwise dispose of property which is not needed for public use where the City's ownership is not limited or qualified nor is the use of such real property restricted and the Council has determined that the property is not needed for public use; and WHEREAS, the City of Springfield gave more than five days public notice of City's desire to dispose of said property in the Register Guard, in accordance with ORS 221.725; and WHEREAS, Springfield Municipal Code Section 2.714 provides that the City may dispose of surplus property by any means determined to be in the best interest of the City with due regard for the value the city will receive from the disposal of the surplus property; and WHEREAS, the City received one offer to purchase the property from Springfield Church of the Brethren for non-monetary consideration described in Attachment 4; and WHEREAS, the City Manager has reviewed said offer and found it to be an acceptable offer for the property; NOW, THEREFORE, IN CONSIDERATION OF THE FOREGOING RECITALS, BE IT RESOLVED AS FOLLOWS: 1. The City Council hereby accepts the offer from Springfield Church of the Brethren, attached as Attachment 4, for said property described in Attachment 3 and directs the City Manager to complete the sale of the property reserving to the City other terms as may be reflected by the approval of this resolution and set forth in the minutes. Matt Stouder, PE Supervising Civil Engineer City of Springfield, Engineering Division 225 Fifth Street Springfield, Oregon 97446 RE: Nonmonetary consideration offer for 642 sf of property in Tax Assessors Map 17-03-35-41 Matt: Springfield Church of the Brethren would like to offer non~monetary consideration to acquire 642sf of City owned property in Tax Assessors Map 17-03-35-41 adjac:ent to 1082 and 1096 Main Street in Springfield Oregon. The nonTmonetary consideration would be the use of the land towards the City goals of mixed use urban development on Main Street. The Church will prioritize affordable housing, built over retail/flex space, with a goal of utilizing state and federal sources of funds to provide additional financial resources to the community and stimulate the Springfield economy. Springfield Church of the Brethren has been providing community service activities on its properties from 1062 to '1096 Main Street for over twenty seven years. Activities have included affordable and supportive housing, fa,ir trade retail, and community religious services. Most recently the Church has supported the development of a HUD 811 Mental Health Housing project on its land that wiU bring nearly 2 million dollars of federal funds for built improvements, and an anticipated minimum of 75 years of rental subsidy for low income tenants. In the down economy the project is providing critically needed design, management and construction jobs to the community.. The HUD 811 project is the first phase of a planned three phase /tUrban Sustainable Village" that is anticipated to include additional affordable housing, retail (or flex space), community, and religious uses, Springfield Church of the Brethren has been a strong partner in City goals by supporting the HUD 811 developer through lot reconfiguration, rezoning, public infrastructure development, and land commitments in furtherance of the housing and the City of Eugene/ Springfield Metropolitan Comprehensive Plan. The Church is proud to be working towards providing new mixed use development at the gateway to the downtown plan district. The development will be an example of how public-private partnership can provide an active, sustainable urban environment for future generations. -.JL I Attachment 4 Page 1 of 2 The property is critical to the effective creation of a Phase II mixed use building on Main Street. Springfield Church of the Brethren desires to provide the frontage of its sites as an urban face to Main Street and to present a mixed use development as a gateway to the downtown core. The property is critical to that effort in that: o Without the property, a jog between the existing lots 1096 and 1082 greatly impacts the available buildable area and developable potential of the land. The unusual dimensional change at the street frontage and its associated property line setbacks would require an inefficient jog in the building form. The jog would greatly reduce the ability to provide for both commercial and residential use. Ownership of the land by the Church will allow consolidation of the properties and a readily developable parcel in furtherance of city goals, . In the current lot configuration, the distance from the back of sidewal~ to the property line distances the building from the urban street edge. This weakens the pedestrian and vehicular connection with the building causing increased vehicular speeds, reduced visibility of signage, reduced sense of pedestrian activity, a reduced visibility for shopping and community ground floor use, and an increased sense of building scale, Ownership of the land will allow consolidation of the properties and thus the development to create an active supportive urban street edge in furtherance of city goals. . The property is too small to be of specific use to others, while every foot of buildable space combined with the existing lots along Main Street greatly improves the viability of any proposed development and supports the vibrancy of an active downtown use.
