DECISION ~ ..
This staff report and decision grants approval with conditions to the subject application, as of the date
of this decision. The standards of the Springfield Development Code (SDC) applicable to each criterion
of approval are listed herein and are satisfied by the submitted plans and notes unless specifically
noted in this decision with findings and conditions necessary for compliance. This is a ministerial
decision made according to city code and state statutes. Unless appealed, the decision is final. Please
read this document in its entirety.

PURPOSE
Approximately 90% of the City of Springfield's drinking water comes from wells that tap the aquifer, an
underground layer of water-bearing sands and gravel. The Springfield Utility Board (SUB) and the City
implement a wellhead protection program to help safeguard the quality of this aquifer and, in turn, the
City's drinking water supply. As stated in SDC 3.3-200, all land in the City limits and the Urban Growth
Boundary within four wellhead Time of Travel Zones (TOTZ) (0-1 year, 1-5 years, 5-10 years, and 10-
20 years) are included in the Drinking Water Protection (DWP) Overlay District.
The land to which the DWP Overlay District is applied is indicated on the DWP Area Maps on file at the
City. The areas within each TOTZ are those drinking water protection areas certified by the Oregon
Health Division, under the Oregon Administrative Rules that apply to Oregon's EPA-approved DWP
Program, in Oregon Health Division Delineation Certification #0002R, dated March 18, 1999.
REVIEW PROCESS
This application has been reviewed under the procedures listed in SDC 5.1-125, Type I Applications,
and SDC 3.3-200, DWP Overlay District. This application was submitted on November 16, 2007, and
this decision is issued 68 days after submittal of the application.
SITE INFORMATION
The subject property is a 7.02 acre (305,791 square feet), irregular-shaped lot on the east side of
RiverBend Drive between St. Joseph Place and Cardinal Way and is located inside the City limits.. The
property was, until recently, vacant but is currently under construction. The property is zoned
Medical Services and designated Medium Density Residential. Land immediately surrounding the
property on the north, south, and east is zoned Medical Services while land to the west is zoned Mixed
Use Commercial. Land in the vicinity of the property is zoned Mixed Use Commercial, Medical
Services, and Medium Density Residential.
DWP OVERLAY DISTRICT - TIME OF TRAVEL ZONES
Finding: The Development Review Committee (DRC), including representatives from the City's
Development Services Department, Fire and Life Safety Department, as well as the Springfield Utility
Board (SUB), reviewed the application, and their comments have been incorporated into the findings
and conditions below.
Finding: SDC 3.3-220 C.1. states that the Lane County Department of Assessment and Taxation
maps shall be used as a base map with the addition of TOTZ boundaries in determining the location of
a property within a TOTZ.
Finding: SDC 3.3-220 C.3. states that tax lots having parts lying within more than one TOTZ are
governed by the standards of the more restrictive TOTZ.
Finding: The development of RMP as part of the Major Site Plan Modification for RiverBend
(DRC2006-00059) will occur on Tax Lot 902 of Map 17-03-22-00. The City's DWP Area Maps indicate
that TL 902 lies within both the one to five year TOTZ and the five to ten year TOTZ for the Sportsway
wellhead. Furthermore, the TOTZ boundary bisects the RMP building. Therefore, the RMP site shall
be governed by the restrictions applicable to the one to five year TOTZ.
Conclusion: This.ap'plication meets the requirements of SDC 3.3-220 C.

DWP OVERLAY DISTRICT - REVIEW
Finding: The DRC, including representatives from the City's Development Services Department, Fire
and Life Safety Department, as well as SUB, reviewed the application, and their comments have been
incorporated into the findings and conditions below.
.Finding: SDC 3.3-225 A. states that a DWP Overlay District Development application is required when
both SDC 3.3-225 A.1. and A.2. are met. A such, the application is required when there is a change of
land use, occupancy, or tenancy of a property, during the building permit process, or in conjunction with
any development application. In addition, the applicable scenario must affect the storage, use, andlor
production of hazardous materials that pose a risk to groundwater or increase the quantity of hazardous
materials that pose a risk to groundwater.
Finding: SDC Chapter 6 defines hazardous materials as those chemicals or substances which are
physical or health hazards as defined and classified in the most recently adopted or amended Fire
Code by the City, whether the materials are in usable or waste condition.
Finding: The development approval for RMP is contained in the Major Site Plan Modification decision
of DRC2006-00059. Therefore, this DWP Overlay District Development application is required in
conjunction with that site plan development application. In addition, given the nature of a medical office
building, the development of RMP will result in the use andlor storage of hazardous materials that pose
a risk to groundwater. Therefore, a DWP Overlay District Development application is required.
Finding: This application meets the requirements of SDC 3.3-225 A.
Finding: SDC 3.3-225 D. states that DWP Overlay District Deveopment applications shall include the
information listed in SDC 3.3-225 D.1. through D.7.
Finding: The application as submitted meets the requirements of SDC 3.3-225 D.1. through D.7.
unless specifically noted with findings and conditions below.
Finding: This application meets the requirements of SDC 3.3-225 D.
DWP OVERLAY DISTRICT - STANDARDS FOR HAZARDOUS MATERIALS
Finding: SDC 3.3-235 states that an application shall be approved or approved with conditions upon
determination that the criteria listed in SDC 3.3-235 A. through D., where applicable, have been
satisfied and that if conditions cannot be attached to satisfy the approval criteria, the application shall
be denied.
Finding: The criteria listed in SDC 3.3-235 B. apply to this application as it is governed by the
restrictions applicable to the one to five year TOTZ.
Finding: The DRC, including representatives from the City's Development Services Department, Fire
and Life Safety Department, as well as SUB, reviewed the application, and their comments have been
incorporated into the findings and conditions below.
Criterion 1 {SDC 3.3-235 B.1.\
The storage, handling, treatment, use, production or otherwise keeping on premises of more than 20
gallons of hazardous materials that pose a risk to groundwater in aggregate quantities not containing
DNAPLs is allowed upon compliance wfth containment and safety standards specified by the most
recent Fire Code adopted by the City.
Finding: The Hazardous Material and Waste Management Plan (HMMP) for the hazardous materials
to be kept on the premises included with this application addresses product and container labeling,
provision of spill kits, spill prevention, and spill clean-up procedures and meets fire code requirements
related to the HMMP and HMIS.
Conclusion: This application satisfies Criterion 1 (SDC 3.3-235 B.1.).

Criterion 2/SDC 3.3-235 B.2.1
Unless exempted, all hazardous materials that pose a risk to groundwater shall be stored in areas with
approved secondary containment in place.
Finding: Annex B of the HMMP included with this application identifies sixteen hazardous material
storage areas: laboratory processing, materials/supplies: pharmacy, housekeeping (7), medications (5),
and endoscope processing. Section 5.1 of the HMMP addresses the secondary containment
requirement.
Condition 1: The secondary containment policy outlined in Section 5.1 of the HMMP is approved as
submitted with this application and shall be followed on the RMP site. As such, prior to occupancy, all
sixteen proposed hazardous material storage areas shall provide secondary containment. In the event
that additional hazardous materials storage areas are used, they must provide secondary containment.
In addition, secondary containment shall be provided for any materials that are added to the HMIS in
the future.
Finding: The applicant has requested DWP exemption for medicines to be used and stored'on the
site, stating that hazardous materials as defined by the SDC are hazardous substances as defined in
the most recent UFC and that UFC 2701.1 Exception 1 specifically exempts medicines from being
considered hazardous materials. As such, medications and pharmaceuticals are not included in the
HMIS and therefore are not proposed to be stored with secondary. containment.
Finding: SDC 3.3-230 states that exemptions are as specified in that section unless the Director, in
consultation with SUB and Fire and Life Safety, determines that a hazardous material that is exempt
pursuant to that section has a significant or substantial potential to degrade groundwater quality. In
such a case, the Director may require compliance with the requirements of SDC 3.3-200 related to that
hazardous material. Such a determination is based upon site and or chemical-specific data. However,
SDC 3.3-230 states that the demonstration of no threat is the responsibility of the applicant seeking the
exemption and will be subject to review by technical experts. In addition, SDC 3.3-230 states that an
applicant may be required to list hazardous materials that are exempt from regulation on the HMIS.
Finding: UFC 2701.1 Exception 1 states that the quantities of medicines not containing more than
50% by volume of water-miscible liquids and with the remainder of the solutions not being flammable, in
retail or wholesale sales occupancies, are unlimited when packaged in individual containers not
exceeding 1.3 gallons, are considered exempt from the hazardous materials provisions of the UFC.
Finding: SUB has submitted comments stating that liquid and solid pharmaceuticals have the potential
to contaminate groundwater when dissolved in water, as in the case of a sprinkler system release.
Condition 2: Prior to occupancy, all medicines and pharmaceuticals considered to 'have the potential
to degrade groundwater quality by SUB shall be provided with secondary containment. Alternatively,
the applicant may provide more information regarding the quantity and types of medications and
pharmaceuticals that will be stored on site so that SUB can determine if such medicines and
pharmaceuticals are eligible for exemption.
Finding: The applicant states in the narrative accompanying this application that although beyond the
requirements in the UFC and Springfield Code, Peace Health agrees to ensure that the storage of
corrosive compounds in quantities less than the thresholds included in the UFC are maintained in
locations that have compatible secondary containment.
Finding: SDC 3.3-200 requires that all hazardous materials that pose a risk to groundwater be stored.
in areas with approved secondary containment. Therefore, storing corrosive compounds in secondary
containment is not beyond ttie requirements of the Springfield Development Code.
Conclusion: This application satisfies Criterion 2 (SDC 3.3-235 B.2.) as conditioned herein.

Criterion 3 ISDC 3.3-235 B.3.1
All new use of DNAPLs is prohibited.
Finding: The HMIS included with this application lists products to be used and stored on the RMP site,
as well as landscaping products to be stored off-site for. use on-site. None of the products listed contain
DNAPLs. .

Condition 3: Chemicals used and stored on the RMP site shall be consistent with those listed on the
HMIS approved as submitted with this application.
Finding: Annex C of the HMMP included with this application outlines a Hazardous Material Review
Procedure designed to evaluate new chemicals for DNAPLs prior to purchase.
Condition 4: Throughout the course of operations, any new chemicals proposed for use and/or
storage shall be evaluated for DNAPLs in coordination with the SU8 Water Quality Protection
Coordinator. In all cases of considering purchase of new hazardous materials, the applicant shall
follow the Hazardous Material Review Procedure outlined in the approved Annex C of the. HMMP.
Finding: Products containing DNAPLs may have specific gravities less than one.
Finding: Annex C of the HMMP included with this application states that products having a specific
gravity less than one are not DNAPLs.
Condition 5: Prior to any occupancy, the applicant shall modify Procedure 3 in Annex C of the HMMP
included with this application to eliminate the statement that products having a Specific gravity less than
one are not DNAPLs. In addition, prior to any occupancy, the applicant shall modify Procedure 3 in
Annex C of the HMMP included with this application to include a guideline regarding looking for 'chlor'
in the names of hazardous ingredients to determine if products contain DNAPLs. . The revised
documents shall be submitted for review and approval by SU8 and the City prior to any occupancy.
Conclusion: This application satisfies Criterion 3 (SDC 3.3-235 8.3.) as conditioned herein.
Criterion 4 ISDC 3.3-235 B.4.1
Any change in type of use or an increase in the maximum daily inventory quantity of any DNAPL is
considered a new use and is prohibited.
Finding: As conditioned in Criterion 3 above, this application meets the requirements of SDC 3.3-235
8.4.
Conclusion: This application satisfies Criterion 4 (SDC 3.3-235 8.4.) as conditioned herein.
Criterion 5 IS DC 3.3-235 B.5.1
The following certain types of facilities or changes in chemical use and/or storage of hazardous
materials that pose a risk to groundwater are prohibited:
a. Hazardous material product pipelines used to transport the hazardous material off of the tax
lot where it is produced or used;
b. Injection wells. EXCEPTION: Dry wells for roof drainage;
c. Solid waste landfills and transfer stations;
d. Fill materials containing hazardous materials;
e. Land uses and new facilities that will use, store, treat, handle, and/or produce DNAPLs.
Finding: The application as submitted complies with SDC 3.3-235 8.5.
Condition 6: Any change to the RMP site shall continue to comply with SDC 3.3-235 8.5.
Conclusion: This application satisfies Criterion 5 (SDC 3.3-235 8.5.) as conditioned herein.

Criterion 6 ISDC 3.3-235 B.6.l
Requirements found in Uniform Fire Code Appendix J/-E 3.2.6 for a monitoring program and in
80003.1.3.3 for monitoring methods to detect hazardous materials in the secondary containment
system shall be met for all amounts of hazardous materials that pose a risk to groundwater unless
exempted.
Finding: Section 10.0 of the HMMP included with this application describes RMP's policies for.
monitoring secondary containment areas.
Condition 7: The secondary containment area inspection policy outlined in Section 10.0 of the HMMP
is approved as submitted with this application and shall be followed on the RMP site.
Conclusion: This application satisfies Criterion 6 (SDC 3.3-235 B.6.) as conditioned herein.
Criterion 7 ISDC 3.3-235 B.7.l
Requirements found in Uniform Fire Code Appendix J/-E 3.2.7 for inspection and record keeping
procedures for monthly in-house inspection and maintenance of containment and emergency
equipment for all amounts of hazardous materials that pose a risk to groundwater shall be met unless
exempted.
Finding: Sections 10.0 and 11.0 of the HMMP included with this application describe RMP's policies
for inspection and record-keeping procedures.
Condition 8: The inspection and record-keeping policies outlined in Sections 10.0 and 11.0 of the
HMMP are approved as submitted with this application and shall be followed on the RMP site.
Finding: Section 7.2 of the HMMP included with this application follows the standard procedures for.
notification of a hazardous material release in Springfield to call 911, which dispatches information to
SUB. Following this procedure is critical so that SUB is notified as soon as possible if a chemical
release has the potential to contaminate wellheads.
Condition 9: The emergency response protocols as outlined in Section 7.0 of the HMMP are approved
as submitted with this application and shall be followed on the RMP site.
Conclusion: This application satisfies Criterion 7 (SDC 3.3-235 B.7.) as conditioned herein.
DWP OVERLAY DISTRICT - CONDITIONS
Finding: The DRC, including representatives from the City's Development Services Department, Fire
and Life Safety Department, as well as SUB, reviewed the application, and their comments have been
incorporated into the findings and conditions below.
Finding: SDC 3.3-240 states that the Director may attach conditions of approval that will minimize
negative impacts of regulated substances on groundwater and ensure that the facility or the proposed
development can fully meet the standards specified in SDC 3.3-235. These conditions may include, but
are not limited to: on-site monitoring wells, Wellhead Protection Area signs, special stormwater
facilities, or other conditions to address specific risks associated with the proposed development.
Condition 10: Materials used for landscape maintenance purposes shall be used according to
manufacturer's specifications only.
Condition 11: Prior to any occupancy, wellhead protection signage in conformance with SUB
standards shall be placed in conspicuous, locations and high risk areas such as parking lots, outside of
structures, building entrances, trash enclosure areas, loading docks, and central receiving areas to alert
staff and visitors to call 911 in the event of a release of hazardous materials. Signs may be field-
located with review staff during site inspections. Contact Amy Chinitz at 744-3745 to purchase signs
from SUB.

and procedures for the RMP site. In addition, prior to final occupancy, the SUB Water Quality
Protection Coordinator shall verify compliance of site improvements with this decision. Contact Amy
Chinitz at 744-3745 to schedule site visits.
Finding: Section 9.0 of the HMMP included with this application states that facility personnel who
handle hazardous materials and hazardous waste may need basic training and direction.
Condition 13: All facility personnel who come into contact with hazardous materials shall receive, at a
minimum, annual training regarding the sensitive area RMP occupies and special precautions needed
to protect Springfield's drinking water. This training shall include familiarization with the HMMP, the
secondary containment requirements, and the need to call 911 in the event of a spill. Contact Amy
Chinitz at 744-3745 to schedule a brief drinking water protection presentation for employees.
Condition 14: Prior to any occupancy, Section 9.0 of the HMMP shall be revised to reflect Condition
13 above. The revised documents shall be submitted for review and approval by SUB and the City
prior to any occupancy.
Conclusion: As conditioned above, this application meets the requirements of SDC 3.3-240.
SUMMARY OF CONDITIONS OF APPROVAL
NOTE: This summary of the conditions of approval is provided as a courtesy to the applicant. The
applicant should, however, carefully read the decision in its entirety to understand the basis for each
condition.
1. The secondary containment policy outlined in Section 5.1' of the HMMP is approved as
submitted with this application and shall be followed on the RMP site. As such, all sixteen
proposed hazardous material storage areas shall provide secondary containment. In the event
that additional hazardous materials storage areas are used, they must provide secondary
containment. In addition, secondary containment shall be provided for any materials that are
added to the HMIS in the future.
2. All medicines and phartnaceuticals shall be stored in secondary containment unless or until
exempted by the Director and the SUB Water Quality Protection Coordinator. Prior to approval
of a DWP exemption for medicines and pharmaceuticals, the applicant shall provide more
information regarding the quantity and types of medications and pharmaceuticals that will be
stored on site so that SUB can determine if such medicines and pharmaceuticals have the
potential to degrade groundwater quality.
3. Chemicals used and stored on the RMP site shall be consistent with those listed on the HMIS
approved as submitted with this application.
4. Throughout the course of operations, any new chemicals proposed for use andlor storage shall
be evaluated for DNAPLs in coordination with the SUB Water Quality Protection Coordinator.

The application, all documents, and supporting evidence are available for free inspection (copies are
available for a fee) at the Development Services Department.
APPEAL
This decision is considered a Type I ministerial decision. Type I decisions are normally exempt from
the provisions of ORS 197.195, 197.763, and 227.173 and therefore cannot be subject to the appeal
provisions of SDC 5.3-100, Appeals. However, SDC 3.3-245 states that SDC 3.3-225 F., the Director's
decision on a DWP application, SDC 3.3-235, Exemptions, and SDC 3.3-235 A.1., Waiver, may be
subject to appeal and that such appeals must be as specified in SDC 5.3-115. .
As such, the aforementioned sections of this decision may be appealed to the Planning Commission.
SDC 5.3-115 states that only the property owner or applicant, if different, have standing to appeal this
decision. SDC 5.3-115 also states that an appeal application in accordance with 5.3-100 shall be filed
with the Development Services Department within 15 calendar days of the Director's decision (the date
of this deCision). In accordance with this policy and the Oregon Rules of Civil Procedures, Rule 10(c),
the appeal period for this decision expires at 5:00pm on February 7, 2008.
