HomeMy WebLinkAboutResolution 10-36 06/07/2010 Resolution No. 10-36 Resolution No. 10-36 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD CERTIFYING ELIGIBILITY FOR STATE-SHARED REVENUES FROM CIGARETTE, GAS AND LIQUOR TAXES, APPROVING THE CITY OF SPRINGFIELD'S PARTICIPATION IN THE STATE REVENUE SHARING PROGRAM, AND DECLARING THE CITY'S ELECTION TO RECEIVE STATE REVENUES PURSUANT TO OREGON REVISED STATUTES 221.760 AND 221.770. WHEREAS, ORS 221.760 in summary provides as follows: Section 1. The officer responsible for disbursing funds to cities under ORS 323.445,366.785 to 366.820 and 471.805 shall, in the case ofa city located within a county haying more than 100,000 inhabitants according to the most recent federal census, disburse such funds only if the city proyides four or more of the following services: 1. Police protection 2. Fire protection 3. Street construction, maintenance and lighting 4. Sanitary sewers 5. Storm Sewers 6. Planning, zoning and subdivision control 7. One or more utility services and WHEREAS, the City of Springfield provides six out of seven municipal seryices enumerated in O.R.S. 221.760: 1. Police protection 2. Fire protection 3. Street construction, maintenance and lighting 4. Sanitary sewers 5. Storm Sewers 6. Planning, zoning and subdivision control and WHEREAS, ORS 221.770 requires the City of Springfield to elect to receiye state revenues under ORS 221. 770 by enactment of an ordinance or resolution expressing the City's election to receive state revenues under ORS 221.770; and WHEREAS, a public hearing before the Budget Committee was adyertised in a newspaper of general circulation on April 15, 2010 and April 21, 2010; and WHEREAS, on May 4, 2010, the Budget Committee held a public hearing giving citizens an opportunity to comment upon the proposed uses of State Reyenue Sharing funds~ and WHEREAS, a public hearing before the Common Council of the City of Springfield was adyertised in a newspaper of general circulation on May 28, 2010; and Attachment] Page 1 Resolution No. 10-36 WHEREAS, on June 7, 2010, the Common Council of the City of Springfield held a public hearing on the proposed uses of State Revenue Sharing funds. NOW, THEREFORE, BASED ON THE FINDINGS SET FORTH IN THE FOREGOING RECITALS, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SPRINGFIELD, A Municipal Corporation of the State of Oregon, as follows: Section 1. The City of Springfield hereby certifies its eligibility to participate in state shared revenues disbursed pursuant toORS 221.760 and compliance with proyisions ofORS 221.770(l)(c). Section Z. Approval is given for the City of Springfield to participate in the State Revenue Sharing program for the 2010/11 fiscal year, beginning July 1, 2010, and ending June 30, 2011. Section 3. The City of Springfield hereby elects to ~eceive state revenues pursuant to ORS 221.770 for the 2010-11 fiscal year beginning July 1,2010, and ending June 30, 2010. Section 4. The City Manager is directed to file a certified copy of this resolution with the State of Oregon, Department of Administrative Services Operations, prior to June 31,2010. Section 5. This resolution shall take effect upon adoption by the Council and approval by the Mayor. Adopted by the Common Council of the City of Springfield this 7th day of June, 2010, by a vote of 5 for and 0 against.
