AN ORDINANCE AMENDING SECTION 4.218(1) OF THE SPRINGFIELD
MUNICIPAL CODE TO REPEAL THE REQUIREMENT TO PAY SANITARY SEWER
USER FEES ONCE A PROPERTY HAS BEEN ASSESSED FOR SEWER
CONSTRUCTION AND SETTING AN EFFECTIVE DATE NOTWITHSTANDING
WHETHER THE PROPERTY OWNER HAS CONNECTED
TO THE COLLECTOR SEWER
WHEREAS, Section 4.218, "Sanitary Sewer and Drainage User Fees-Person Financially
Responsible", Subsection (1) now reads as follows:
"4.218 Sanitary Sewer and Drainage User Fees-Person Financially Responsible.
(1) Sanitary sewer user fees called by this article shall be charged to any person
erecting or maintaining a drain for the discharge of sewage to a collector sewer, and to any
property located in the city which has been assessed for the construction of a collector sewer and
which is located on property any point of which is within 120 feet of a collector sewer to which
the property has access."
WHEREAS, said requirement applies to any property located in the City which has been
assessed for the construction of a collector sewer and which is located on property any point of
which is within 120 feet of the collector sewer NOTWITHSTANDING whether the property
owner has connected to the collector sewer; and
WHEREAS, the staffhas recommended and the Council has determined to only charge sanitary
sewer user fees to those persons erecting or maintaining a drain for discharge of sewage to a
collector sewer.
NOW THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY
OF SPRINGFIELD THAT:
Section 1. Section 4.218 "Sanitary Sewer and Drainage User Fees-Person Financially
Responsible" Subsection (1) of the Springfield Municipal Code is hereby amended to read as
follows:
"4.218 Sanitary Sewer and Drainage User Fees-Person Financially Responsible.
(1) Sanitary sewer user fees called by this article shall be charged to any person
erecting or maintaining a drain for the discharge of sewage to a collector sewer. "
Section 2. This ordinance shall take effect for all bills rendered on or after thirty days after this
ordinance shall have been approved by the Mayor.
Adopted by the Common Council of the City of Springfield, Oregon, by a vote of ~
for and ~ against, this 17th day of May ,201 .
