Piease work with Jim D. re these sorts of questions to get the quickest response. Here's a belated answer,
though. No permit necessary for cutting trees in the right of way, but the proper context for "private property" in
this sense DOES require zoning ccimpliance for cutting trees on the lot. You may, never the less, be under the
threshold depending on what and the size of the trees to be removed. This is not a big deal. Sorry for the delay
in responding.

Bill,
I was preparing to work on a tree felling permit for the Ancillary building and secure parking lot
of the Justice Center. As I was re-reading the SDC I read the section (excerpted below) that
says the permit is required for "private property". Does this mean that a permit is not
necessary for this project since the parcels in question are under Public Ownership and/or
ROW?
Please let me know if this is the case prior to me filling out the permit form. If a permit is not
needed, great; if it is needed I need to get it in today so it can proceed along at the same pace
of the Major Site Plan Modification I turned in yesterday for this part of the project.

A. A Tree Felling Permit shall be required prior to the felling of more than 5 trees S-inch dbh
(diameter at breast height) or larger within a period of 12 consecutive months from a lot/parcel of private
property under common ownership consisting of 10,000 square feet or more of total area.
