Tree Felling Permit Application Process
.
1. Applicant Submits a Tree Felling Permit Application to the Development Services
Department
. The application must conform to the Tree Felling Permit Submittal Requirements
Checklist on page 4 of this application packet.
. Planning Division staff screen the submittal at the front counter to determine
whether all required items listed in the Tree Felling Permit Submittal Requirements
Checklist have been submitted.
. Applications missing required items will not be accepted for submittal.
2. City Staff Conduct Detailed Completeness Check
. Planning Division staff conducts a detailed completeness check within 30 days of
submittal.
. The assigned Planner notifies the applicant in writing regarding the completeness .of
the application.
. An application is not be deemed technically complete until all information necessary
to evaluate the proposed development, its impacts, and its compliance with the
provisions of the Springfieid Development Code and other applicable codes and
statutes have been provided.
. Incomplete applications, as well as insufficient or unclear data, will delay the
application review process and may result in denial.

3. City Staff Review the Application and Issue a Decision
. This is a Type II decision and thus is made after public notice, but without a public
hearing, unless appealed.
. Mailed notice is provided to property owners and occupants within 300 feet of the
property being reviewed and to any applicable neighborhood association. In
addition, the applicant must post one sign, provided by the City, on the subject
property.
. There is a 14-day public comment period, staring on the date notice is mailed.
. Applications are distributed to the Development Review Committee, and their
comments are incorporated into a decision that addresses all applicable approval
criteria and/or development standards, as well as any written comments from those
given notice.
. Applications may be approved, approved with conditions, or denied.
. The City mails the applicant and any party of standing a copy of the decision, which
is effective on the day it is mailed.
. The decision issued is the final decision of the City but may be appealed within 15
calendar days to the Plannin?COmmiSsion or Hearings Official.

Services Department. The applicable application, technology, and postage fees are

Copy of the Deed
Copy of a Preliminary Title Report issued ;within the past 30 days documenting
ownership and listing all encumbrances.
Narrative explaining the proposal and any additional information that may have a bearing
in determining the action to be taken, including findings demonstrating compliance with
the Tree Felling Permit Criteria as specified in SDC 5.19-125 (see page 4 of this
application).
NOTE: Before the Director can issue a Tree Felling Permit, information submitted by the
applicant must adequately support the request. All of the Tree Felling Permit Criteria must
be addressed by the applicant. Incomplete .applications, as well as insufficient or unclear
data, will delay the application review process and may result in denial. In certain
circumstances, it is advisable to hire a professional planner or land use attorney to
prepare the required findings.
The Director or the Public Works Director may require the applicant to provide the
services of a professional forester (approved by the City), licensed hydrologist, or licensed
landscape architect in order to address the standards in SDC 5.19-125 for undeveloped
property greater than 10 acres in size or 15% slope or above an elevation of 670 feet.

To Whom It May Concem:
Conceming the tree removal ofsix(6) Douglas fir trees located adjacent to 1505 mohawk
blvd. and on 1537 mohawk blvd. property. 1 am requesting a tree felling permit to remove
6 Doug fir trees to prevent hazards and destruction to public, pedestrians,buildings,and
other personal properties. Area will be replaced with a swale incorporated with the re-
building of the taco bell restaurant located at 1505 Mohawk blvd.,the trees will be
removed in blocking fashion to prevent opportunities for accidents, traffic disturbances
and other related tree falling issues. All debris and stumps will be removed. The removal
will done by a licensed professional, bonded and insured.

Agreement to Allow for the Cutting of Trees
PARTIES:
Mohawk Taco, LLC
(Mohawk)
and
Abraham Velazco and Irma L. Morales
(Velazco/Morales)
RECITALS:
A. Mohawk leases the property located at 1505 Mohawk Boulevard in Springfield, Oregon
(Mohawk Property). Velazco/Morales own the property located at 1537 Mohawk Boulevard in
Springfield, Oregon (Velazco/Morales Property). The Mohawk Property and Velazco/Morales
Property abut each other.
B. There are six (6) Douglas Fir trees (the Trees) on the Velazco/Morales Property that create a
border between the Velazco/Morales Property and the Mohawk Property. Mohawk has requested
permission to enter upon the Velazco/Morales Property for the purpose of cutting down the six (6)
Douglas Fir trees and Velazco/Morales have agreed to allow Mohawk such access on the terms and
conditions set forth below.
C. Mohawk will contract with a professional tree service (Contractor) for the actual cutting down
of the Trees.
Now, therefore, the Parties agree:
AGREEMENT:
1. Right to Access/Scope and Manner of Cutting Trees. The parties agree that Mohawk and
its Contractor shall have all necessary access to the Velazco/Morales Property in order to cut the
Trees. Velazco/Morales further agree that the manner and scope of the cutting of the Trees shall be
negotiated by Mohawk and the Contractor in a separate agreement. The parties further agree that
neither Mohawk nor its Contractor shall be liable for a timber trespass based on the cutting and/or
removal of the Trees.
2. . Claim for Damages. All claims for damage or loss as a result of or in connection with the
cutting of the trees shall be made against the Contractor.
3. Consideration. The parties agree that Mohawk shall bear the financial responsibility with
respect to the cutting down of the Trees including hiring the Contractor and paying for any permits
that may be necessary. The parties further agree that it is mutually. beneficial for the parties to have
the Trees cut down.
4. Rights to Trees. The parties agree that Mohawk shall be entitled to the Trees and that
Mohawk shall have complete discretion regarding the utilization of the Trees once they have been
cut down. The parties further agree that Velazco/Morales have been adequately compensated by
virtue of Mohawk paying for the Trees to be cut down. Date Received:

5. Controlling Law and Venue. This Agreement shall be interpreted and enforced according to
the laws of the State of Oregon. Any action related to this Agreement shall be commenced in Lane
County Circuit Court located in Eugene, Oregon.
6. Entire Agreement. This Agreement sets forth the entire agreement between the parties and is
intended to be final and binding on them. This Agreement supercedes all prior or contemporaneous
agreements, understandings, or representations on the subjects contained herein.
7. Attorney Fees. In the event an action is commenced to enforce any term of this Agreement,
the prevailing party shall recover from the losing party reasonable attorney fees incurred in such
action as set by the trial court, arbitrator, or mediator as the case may be, and in the event of appeal,
as set by the appellate courts.
8. Modifications to Agreement. All modifications to this Agreement must be made in writing
and signed by all parties.
9. Facsimile Signatures and Counterparts. Facsimile signatures and counterpart signatures are
acceptable as if they were original signatures.
