RE: Waiver and Time Extension for 120 day decision period Nicely done Andy. lets see however, if Bill reminds us that we can suggest rather than request a 120waiver;-) JD From: LIMBIRD Andrew Sent: Thursday, April 01, 2010 10:35 AM To: 'billkloos@landuseoregon.com'; 'bwellard@thechildcenter.org' Cc: DONOVAN James; 'Mary Bridget Smith'; LEAHY Joe (HL) Subject: Waiver and Time Extension for 120 day decision period Bill: Thank you for meeting with staff and City legal counsel on Tuesday afternoon. Staff is finalizing the amended staff report and decision for The Child Center based on our productive discussion. To ensure that staff can issue the amended decision and postpone the Planning Commission hearing, the City requests that you complete and submit the attached waiver of the 120 day time limit for this decision. The application was submitted and deemed complete on January 21, 2010 and today (April 1) is Day 70 of the timeline. It is possible, although not certain, that all avenues of appeal could be accommodated within the 120 day period (ie. by May 21, 2010). However, to ensure there is adequate time for re- issuance of the decision (along with a new 15 day appeal period) and rescheduling of a Planning Commission appeal hearing (if necessary), staff requests the time extension. Please let me know if you have any questions. Thanks Andy limbird City of Springfield 1 Date Received: il;/;}blo Planner: AL
