Thanks Greg. This is just one item that we will be discussing with the appellant before the appeal hearing and, based on
your response, it looks like the City may be prepared to concede this point. Two segments of the damaged sidewalk will
be removed to accommodate curb cuts, driveways and ADA ramps when the site develops. This will reduce the number
of sidewalk panels requiring replacement, but I'm not sure how much linear distance will remain.

So I talked to Brian. His recollection is that the City as well as the county and/or SUB may be responsible for the
damage. No concrete answer as to who did it. Brain did authorized a sidewalk repair based on a discussion that our
mower may have done the damage.
I think the Maintenance Division would not support a rebuttal to the appeal. It would be hard to argue that the
property owner is responsible when another agency may have done the damage. Somewhat falls to our arena as we are
the maintainers ofthe City infrastructure.

I
You have been here a long time. What do you recall about the sidewalk off Marcola road before crossing the river. It is
in front of the school. In a drc we asked the school to fix the sidewalk as a requirement for development. They
appealed stating that maintenance activities did the damage. looking for any information you may have.

I took some measurements beginning on the furthermost eastern end of the sidewalk in question. All widths are 7'.
Next to the driveway is a cracked 7' panel. Approximately SO' to the west begins the long crack that appears to be many
years old. This cracked sidewalk continues for 260'. Continuing west there is 49' of newer sidewalk that is cracked
similarly. Continuing further west near the small "off the sidewalk" ped-electric station there are additional panels
cracked in the same manner. I measured 56' more that is cracked here.
I would need to get a bid for an accurate cost for such a large job.

Hi Greg: As requested after our discussion, I drove out to Marcola Rd with Todd. The sidewalk from south of the bridge
on the east side. The city did consider the area from east side ofthe sidewalk to the fence as R.O. W. The further north
the wider the R.O.W. We had a smaller tractor with a side mounted mower at that time. This area was on the mow list
and the tractor would drive down the sidewalk mowing. There was cracking even back then. There is also different
utilities in this area, and they would and still set up or cross the sidewalk when working in this area. Todd measured the
cracked area, can add to this e-mail from his notes and pass it on to you Greg.
