Jo~: Planning has received an appeal of a Director's land use decision issued March 2, 2010.
The subject application is a Type II site plan review for The Child Center at 3995 Marcola
Road (Case DRC2010-00004).
The appellant is challenging nine conditions of the approval and the application fees. A
Planning Commission appeal hearing is tentatively scheduled for April 13, 2010. I would like
to confer with Legal Counsel on this appeal and determine the best course of action. Please
let me know if you, Bill or Mary Bridget will be handling this appeal, and a preferred time
to meet. On Monday afternoon I am meeting briefly with the Engineering, Fire, Building and
Transportation staff that worked on this application to discuss the appeal.
I have attached a copy of the staff report and the appeal narrative for your reference.
