AN ORDINANCE ADOPTING THE REPORT OF THE CITY ENGINEER FOR IMPROVEMENTS ON SOUTH 38TH
STREET AND CHEROKEE DRIVE AND VICINITY (P21032)
NOW, THEREFORE, THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS:
Section 1: The Springfield City Council on November 2, 2009, did declare intention to initiate
construction of public wastewater improvements on South 38th Street and Cherokee Drive, and Vicinity
(P21032). At the direction of the Council, the City Engineer filed his report with the City Finance Director
on March 22, 2010.
Section 2: Upon receipt of the above Engineer's Report, the Finance Director gave notice
informing all interested property owners benefitted by the proposed improvement to appear before the
Council in the City Council Chambers, City Hall, 225 Fifth Street, Springfield, Oregon, on April 5, 2010, to
present their views for or against such project. The public hearing was held and people appeared to
testify for and against the project.
Section 3: The Council finds that less than two-thirds of the property owners have filed
objections, and after hearing any objections finds the Engineer's Report to be just and reasonable and
said Engineer's Report is therefore hereby adopted.
Section 4: The Finance Director is directed to advertise that bids will be received for the
construction of the above improvement project in accordance with the City's general conditions and
standard specifications and that the project shall be awarded in the City Council Chambers of City Hall.
The Council reserves the right to reject any or all bids deemed unsatisfactory.
Section 5: The Finance Director is directed to post notice of pending assessments on the City's
lien docket for properties that will be assessed for the cost of this project.
Adopted by the Common Council of the City of Springfield, Oregon, by a vote of
~ for and ~ against, this 3rd day of May 2010.
Approved by the Mayor of the City of Springfield, Oregon, this 3rd day of May, 2010.
