AMOR TRUST TENTATIVE PARTITION APPLICATION This application is a proposal to partition a multi-family development on the property at 6595 Main Street (Map 17-02-34-44, Tax Lot 1200) into two parcels. Currently, the property has a single family residence, fourplex and parking area. The property is a parcel in a recent partition (SUB2008-00016). That partition was primarily intended to separate the vacant, undeveloped land from the multifamily development. Since then jt has been found that inclusion of 5 dwelling units on one parcel forces any buyers to obtain a commercial loan (5 or more dwelling units) instead of a residential loan (4 or fewer dwelling units). Since commercial loans have a significantly higher interest rate, this impacts the marketability of the property. This partition is to reduce the number of dwelling units on one property so that buyers qualify for residential loans, increasing the marketability and thus property value. Patrick S. Thompson, Consulting submitted a wetland delineation to DSL as part of the previous Site Plan Review (DRC2005-00007). A copy of the DSL approval report is included with this submittal. . Since Main Street is fully improved, no off-site improvements are necessary now or in the future. No construction is anticipated for this partition in the foreseeable future. All utilities and drive area used by this partition but outside its boundaries are covered by existing easements created during the previous partition. Those easements needed for the fourplex's utilities that cross the single family home's parcel are covered by easements created with this partition. No trees will be removed with this land use application. The existing single-family house will continue to drain its gutters to the ground around the foundation. The roof drains from the existing fourplex and both duplexes (on the other two parcels in the previous partition) will continue to drain directly to the storm drainage system in Main Street. The runoff from the parking and driving areas from the entire development flow through the swale between the fourplex and existing house before draining to the storm drainage system in Main Street. The swale cleanses the water then releases it to the Main Street storm drainage system. A permit was acquired from ODOT to connect to the Main Street storm drainage system. This application includes copies of the stormwater report approved by ODOT during the permitting process. The existing approach was approved by ODOT under permit No. 51643. A copy of the permit is included in this submittal. During the previous partition Mike Wilber at ODOT stated in a phone call that since the partition does not create the ability for new buildable areas to access Main Street, a Change of Use Permit is not required. However, the Final Plat will show a restriction that if any additional units are constructed to access Main Street, a Change of Use Permit will be obtained. The Lane County Soil Survey shows the site as having Coburg-Urban Land Complex (#32). The Soil Survey indicates that Coburg-Urban Land Complex soils have a seasonal high water table of 1.5 to 2.5 feet deep from Nov. to Dec. Because of the potential high water table, Ron Detrick provided a Geotechnical Investigation with the previous site plan submittal that determined ground water will not be a concern for this project. A copy of the report is included. The title report lists an easement to the City of Eugene (filed as Book 83, Page 377). However, this easement is on the north side of Main Street and does not cross the site. This application does not require any additional planning applications.
