WESTWIND ESTATES PROPERTY LINE ADJUSTMENT
LOTS 99-101
Hayden Homes is proposing a property line adjustment for lots 99, 100 and 101 in the Westwind
Estates subdivision. The purpose for the property line adjustment is to meet city setbacks for
the proposed Hayden Giving Fund home on lot 99. The property line between lot 99 and 100 as
well as between 100 and 101 will be shifted north approximately 10'.
The property line adjustments are in compliance with the following SDC 5.16-125:
A. Create a new lot/parcel;
a, No new lot/parcels created.
B. Create a landlocked lot/parcel;
a, No landlocked lot/parcels created,
C. Reduce an existing lot/parcel below the minimum size standard or reduce
setbacks below the minimum established by the applicable zoning districts in this
Code;
a, The proposed property line adjustment is being made so that minimum
setbacks are met. The adjusted lots meet minimum size standards for the
established zoning,
D. Violate any previous conditions the Approval Authority may have imposed on the
lotslparcels involved in the application;
a, No previous conditions regarding lot/parcels are involved.
E. Detrimentally alter the availability of existing public and/or private utilities to each
lot/parcel in the application or to abutting lots/parcels;
a. The existing utilities are not affected by the proposed property line
adjustment.
F. Increase the degree of non-conformity of each lot, parcel or structure that is non-
conforming at the time of application.
a. There are no existing structures and the proposed change allow for
conformity on all/ots.
