At llie time orthe site review, the zoning on the property was MDR, but the Metro Plan designation' was LOR. As acondition of the site review approval, a zone change was completed to change the zoning to LOR. This created a non.conforming use as the development was approved lor a density of 14.6 units/acre. The fcur duplexes are currently under construcrion on th" site. Due to the economic climate of the area,:ihe. banks will not give a permanent loan on the property ifit has more than 4 units:(there are currently 8). This is what has generated this request to partition the property into 2equal!y sized lots with 4 units ,1n each parcel. Questions 1. We have designed 'the partition 'to have equal parcels after recording. This will keep. the current density at 14.6 units/acre (non-conforming use) on each parceL but ,will not increase. thc non~cQnfoimity to the density standard. Will the City of Springfield accept this logic 'and allow the partition' to be approved in regards t(i density st:mdards? 2. The eXlsti,ng lot is only 70 fcet in width. Therefore,a minor variance would be required'to adjusfthe minimum lot width requirement in the code. The code requirement is 60 feet, and to keep this as a minor variance, the maximiuil ddjustment could be an J 8 foot reduction (30%). We are propofing to reduce the width of the frontage 5 feet to a lot'width of 55 fcct. Would the City orSpringfieJd support this variance [or this proposal? -~. " " 3. Since tlie lot is no\v LOR, the code only requires a panhandle width of J 4 feet. Therefore, we do not believe a variance would be required for the panhandle width.' We.,still will construct a 20 wide driveway in the easement that was showif 011 the site 'review to maintain safe ingress/egress and for fire safety. Does the City of Springtleld agree that a variance is not needed for the panhaJ1dle '!sproposed?' . 4. We did'not see any other. variances that would be needed to meet code criteria, for a partition. Does the City of Springfield see any other issues with this proposed partition that would prevent approval?
