Dear Tara,
As discussed, enclosed are the foilowing materials the supplement our request for a Development Issues
Meeting for the project referenced above:
1. One (1) completed Development Issues Meeting form
2. One (1) check for $175 for the balance of the application fee
3. Fifteen (15) copies of the Q Streetweilhead protection map with site plan overlay
The proposal is to construct a Fred Meyer retail fueling facility consisting of a 24- by 145-fool
(3,480-square-foot) canopy with an 8- by 14-foot (112-square-foot) cashier's kiosk. The facility will
provide five (5) multi-product dispensers for a total of 10 fueiing positions The faciiity will include
two underground storage tanks measuring 20,000 gailons and 18,000 gailons in size. The project will
operate for 24 hours/7 days a week and will be fuily attended pursuanl to Oregon State law. Please refer
to the enclosed plans for more detail.
The project is located inside a portion of the site that is mapped as a 1-5 year wellhead time of travel
zone (TOTZ). Because a portion of the property also lies within the 0-1 year TOTZ, we are seeking Ihe
Director's consideration of a waiver from the more restriclive standards pursuant to Section 3.3-200 of the
Springfield Development Code. The project wiil provide secondary containment and an ,inspection
program pursuant to City requirements for a 1-5 year TOTZ, and wiil be state of the art in design.
The project wiil also bring parking below the required amount by approximately 42 stails. Because this is
Jess than 20 percent of the 10tal amount required, we are seeking the Director's consideration of a parking
reduction pursuant to Section 4-6.125.G.1 (a). We understand that a parking generation study wiil be
required for the Director's review.
Below are our five (5) questions for the Development Issues Meeting:
1. What specificaily must Fred Meyer submit to the City of Springfield and the Springfield Utiiity
Board to demonstrate the project's compliance with the weilhead protection rules?
2. What special conditions of approval for groundwater protection, construction, and monitoring
could the City require as part of a Director's waiver from the more restrictive standards for
wellhead protection?
3. Is the Fred Meyer store subject to the wellhead protection review even though the fuel center'
is a separate project on another part of the site?
4. What is the scope of the required traffic impact analysis and parking generation study?
5. What process is available to request SDC reductions and/or credits?

ADDITIONAL COMMENTS/APPLICABLE SPECIAL USE STANDARDS
Additional Use of25 space LTD Park and Ride addded to site. Information sent by Tracy Smith of
L TD. There are 475 existing parking spaces with 520 required for the 156,000 square foot store.
There is a current deficit of 45 spaces and a proposed deficit of 70 with the 25 proposed park & ride
spaces (attached). Site visits to the store have shown that the parking lot seems to be underutilized
particularity on the west side of the store where the Park & Ride is proposed. Due to the current
deficit in parking per the SDC and the proposal to increase this deficit the following conditions shall
apply to this approval:
1. An evaluation ofthe parking lot shall be performed in mid October (on a week day) by L TD with
input from the Manager at the Fred Meyer store. This evaluation shall review the use of the Park &
Ride and it's affect on the parking availability at the store. The evaluation shall be submitted to the
City of Springfield for review by October 31, 2009.
2. No additional temporary uses (such as fireworks stands or Christmas tree lots) or permanent uses
shall occur in the parking lot white the Park & Ride exists on site without a parking and traffic
impact analysis.
Please note that all other additions io the sIte, including build~ng expansions, must meet minimum
parking requirements or will require a parking analysis and approved variance which Includes the
25 space Park & Ride, if the agreement and useis still in effect.
STATEMENT OF COMPLIANCE
By Signature, I state I have carefully examined this change.of use approval and do hereby agree
to comply with the requirements of the approval and certify any and all work performed shall be
done in accordance with the Ordinances of the City of Springfield, applicable City Standard
Specification and Drawings and the laws of the State of Oregon pertaining to the work described
herein.
The City may inspect the work site described in this approval at any time during a one-year
period following the receipt by the City of notice of completion of the described work and
specify, at the City's sole discretion, any additional work required to bring the site into
compliance with all applicable City standards. In the event conditions are not met prior to
occupancy of the building or within thirty days of issuance of the approval, Code Enforcement
will be no . fied of an infraction and a citation may be issued.

PARKING FACILITY AGREEMENT
In consideration of the covenants set forth below, Fred Mever Stores , hereinafter referred to as
"Owner," and LANE TRANSIT DISTRICT. a Municipal Corporation of the Slate of Oregon, acting by
and through its Board of Directors, hereinafter referred to as "L TO," mutually agree to the use of
parking facilities on the premises at 650 "0" Street, Springfield, Oregon, as described in "Exhibit A."
The terms and conditions of use are:
1. TERM. The term of the lease shall be one (1) year and sh,all continue thereafter.fromyear-to-year
until terminated by mutual agreement or by either party giving at least ninety (90) days' advance
notice (written) to the other party.
2. USE. Said property is to be used as a "Park & Ride" parking facility for the parking of passenger
vehicles by L TO's bus passengers and rideshare participants. The majority of use Is expected to
occur between the hours of 6:00 a.m. and 6:00 p.m., Monday through Friday, although parking may
occur al any time during scheduled bus operating hours. L TO assumes responsibility for the
installation of Park & Ride signs and, if deemed necessary, signs prohibiting the parking of 'for
sale" vehicles.
3. SECURITY. Owner has no duty under this Agreement to provide security for the vehicles parked
on the premises for "Park & Ride" purposes. .
4. INDEMNITY. L TD agrees to indemnify and hold the Owner harmless from all liability on account of
personal Injury and property damage on or about said property directly caused by L TO's fault or
neglect.
5. NOTICES. Notice to either party shall be deemed effective when delivered and receipted for in
person, or when mailed by registered or certified mail, return receipt requested, with postage fuily
. prepaid, or delivered by express mall, addressed to the .other party at the following. address.

6. OWNERS' COVENANTS. The owners' covenant that they are the sole owner of said property free
and clear of encumbrance and have good right to sign this lease, and that as long as L TO fully
performs its obligations under this lease, It will have quiet and peaceful occupancy of said property.
7. DEFAULT. If either party shall be in default in the performance of any provision of this lease and
shall fail to cure such default within thirty (30) days after default notice from the owners, in any such
event the aggrieved party shall be entitled to terminate this lease and pursue such other remedies
as may be available.
